The ICJ is expected to make a ruling on the dispute in mid 2013.

A fair outcome by the court will end the sole remaining border issue which compromises our bilateral relations.

However, the Court did not address the issue of the effects of armed conflict on validity or suspension in the Nicaragua case.

Before reporting the different viewpoints, a brief background on the legal implications of the dispute and sentences is necessary.

The Nuclear Weapons opinion is the closest that the Court has come to examining the effects of armed conflict on treaties, including significant discussion of the effect of armed conflict on both human rights and environmental treaties.

In a brief submitted to the Court by the Government of Solomon Islands, the question of the effects of armed conflict on treaties was examined thoroughly.

As in the Oil Platforms case, the Court considered the Treaty of Friendship, Commerce and Navigation to be in force notwithstanding the armed conflict between the two parties and considered potential breaches of the Treaty in detail.

The Supreme Court of Seychelles considered the effect of armed conflict on treaties in a 1973 case involving the extradition of an Italian arrested in Seychelles.

What the court has done is to craft a solution that no political process could have arrived at independently, but which takes the dispute off the streets.

In its advisory opinion on the Legality of the Threat or Use of Nuclear Weapons, the Court cited international humanitarian law as the prime example of treaties applicable in armed conflict.

It is precisely with a view to helping the parties to a dispute to resolve it through legal means, through the Court, that in 1989 the Secretary General's Trust Fund was created to assist States in the settlement of disputes.

The effect of armed conflict on environmental treaties was also a significant source of discussion in the course of the International Court of Justice advisory opinion on nuclear weapons, both in the submissions of the parties and in the opinion of the Court.

However, the Court is of the view that the issue is not whether the treaties relating to the protection of the environment are or are not applicable during an armed conflict, but rather whether the obligations stemming from these treaties were intended to be obligations of total restraint during military conflict.

More ominous, however, is the sovereignty dispute between Japan and China.

The key dispute is over Cyprus.

The outbreak of an armed conflict does not affect the competence of the parties to the armed conflict to conclude treaties in accordance with the Vienna Convention on the Law of Treaties.

The two nations with most economic and political stakes in the conflict are Rwanda and Uganda.

That was not the case in the present dispute.

That was not the case in the dispute at hand.

Treaties applicable to situations of armed conflict in accordance with their express provisions are operative in case of an armed conflict, without prejudice to the conclusion of lawful agreements between the parties to the armed conflict involving suspension or waiver of the relevant treaties.

The internal armed conflict

Upon receiving the unanimous consent of the States parties to the dispute regarding the composition of the Commission, the Chairman shall proceed to the appointment of the members of the Commission and shall inform the States parties to the dispute of the composition of the Commission.

The critical issue, however, was not the date when the dispute arose, but the date of the facts or situations in relation to which the dispute arose.

In one respect, then, the dispute appears set to follow a path similar to the US Japan case.

All MOTAPM minefields emplaced during the conflict should be cleared as soon as possible upon cessation of the conflict.

Several delegations expressed support for the interpretation that peacebuilding comprised operations undertaken in pre conflict, in conflict and post conflict situations.

But the deal has not stuck, and the conflict has continued.

The root of the dispute was fundamental differences of ownership.

The judgment is also significant because the court held that armed conflict cannot bring about the extinction of treaties, but may contribute to a supervening impossibility' and perhaps to a change in the circumstances (rebus sic stantibus) .
