Over the years, the judiciary has contributed significantly to the development of the right to equality in general, and to gender equality in particular.

Ms. Briskman Gomelski (Israel) said that although the Basic Laws did not proclaim the right to equality, they referred to the right to dignity, which the Supreme Court and lower courts had interpreted as including gender equality.

It follows, then, that the right to equality could be violated even where another legal right to, say, housing or employment does not exist.

The United Nations Population Fund has declared that men and women have a right to equality.
