The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, considers that the deportation of the complainant to Algeria constituted a breach of articles 3 and 22 of the Convention.

He further urges them to consider similar steps with regard to the Optional Protocol to the Convention against Torture .

The Cabinet of Ministers had subsequently adopted an action plan for 2004 2005 to implement the Convention against Torture.

Another proposed replacing  agents of the State by public officials , as in article 1 of the Convention against Torture.

Some suggested that the fact finding function should follow the lines of article 20 of the Convention against Torture.
