A similar process is used to calibrate the compass in light general aviation aircraft, with the compass deviation card often mounted permanently just above or below the magnetic compass on the instrument panel.

In the light of these findings, the Panel determines that a global downward adjustment is not warranted.

We wish, however, to reiterate the Nigerian position that such an instrument should be considered as only a stopgap measure, for we believe that it is only through a legally binding international instrument that the transfer of small arms and light weapons to non State actors can be controlled and criminalized.

Indeed, the definition of the offence contained in the current draft uses precise technical, legal language more suitable for a criminal law instrument than the language used in the report of the High level Panel.

My country therefore believes that one fundamental element in controlling the illicit trade in small arms and light weapons would be to negotiate a legal instrument regulating the transfer of such arms.

The proposed text for draft article 3 should be inserted in the draft instrument for continuation of the discussion at a future session in light of the views and clarifications expressed above.

In addition to general adjustments to the proposal made necessary in light of changes under consideration for the jurisdiction provisions in the draft instrument, certain specific modifications to the proposal were suggested.

Nigeria therefore welcomes the agreement of June 2005 on an international instrument that would enable States to identify and trace illicit small arms and light weapons in a timely and reliable manner.

He called for a consensus on various substantive issues pending in the process of negotiating the draft international instrument to enable States to identify and trace illicit small arms and light weapons.

It would be helpful if ECOWAS member States converted the moratorium on the importation, exportation and manufacture of small arms and light weapons into a legally binding instrument at the earliest opportunity.

However, at this stage it would be premature to speak of pushing for the drafting of a legally binding international instrument on the marking, tracing and brokering of small arms and light weapons.

In light of the decision of the Governing Council, the Panel does not consider it necessary to make any recommendations with respect to interest on the awards recommended in this report.

The European Union recalls that it is working towards the adoption of a legally binding instrument on the identification and tracing of small arms and light weapons to supplement the United Nations Firearms Protocol.

It was also indicated that consideration should be given to the possibility of extending the protection granted by the article to all performing parties in light of the multimodal nature of the draft instrument.
