E. Situation of the Constitutional Court and the Supreme Electoral Court

The absence of an independent Constitutional Court and Supreme Court was extremely worrying.

The judicial power is vested in the Constitutional Court, Supreme Court and the Economic Court.

The Supreme Court acts as a Constitutional Council in resolving constitutional questions and supervising presidential elections.

The judiciary comprises the Supreme Court and specialized courts such as the Constitutional Court, which deals with specific issues related to constitutional and business law.

Key institutions, including the Constitutional Court, the Supreme Court, and the Senate of the Republic, are being eroded.

The Supreme Court allegedly totally ignored the Constitutional Court's decision in the author's case.

The amended constitution expands the constitutional court and the supreme council of judges and prosecutors.

The Supreme Court, which oversees the constitutionality of laws, guarantees judicial protection for these constitutional principles against any infringement by a new law.

1.2.2.3.1 Constitutional Court

The author's appeal to the Supreme Court was declared inadmissible on 26 September 1996, and an appeal to the Constitutional Court was dismissed on procedural grounds on 7 October 1998.

In its judgement, the Constitutional Court stated that it was not in its remit to review the weighing of the evidence done by the trial court, or to review the conclusions of the Supreme Court.

The first substantive issue addressed in the report (paras. 11 29) concerned his two missions to Ecuador, in April and July 2005, following the unconstitutional dismissal of the Constitutional Court, Supreme Electoral Court and Supreme Court and the subsequent ousting of the President of the Republic, Lucio Gutiérrez.

The majority of the Supreme Court of Canada found that an implied negative right not to associate existed but that the legislation was constitutional.

(a) The Supreme Court

The Supreme Administrative Court of Finland (, ) is the highest court in the Finnish administrative court system, parallel to the Supreme Court of Finland.

April 2001 Represented the Federal Government of the Islamic Republic of Pakistan in important constitutional matters of public importance before the Supreme Court of Pakistan.

According to the judgement of the Constitutional Court, the Court decided that the alleged violation of lack of impartiality of the judges was inadmissible due to the author's failure to raise the issue before the Supreme Court.

This situation came about because all the members of the Constitutional Court were dismissed and it is legally impossible to set up a new Court until the Supreme Court, which is responsible for submitting a shortlist of candidates, is appointed.

The Supreme Special Court is also the Supreme Electoral Court, judging pleas against the legality of the legislative elections.

The Special Rapporteur is concerned to note that, in the absence of a Supreme Court, which is responsible for proposing a shortlist of candidates, it is impossible to appoint the members of the Constitutional Court.

The Supreme Court is made up of High Court and Court of Appeals.
