The issue of housing rights is relevant, and the above mentioned guidelines in progress by Mr. Pinheiro on the right to housing will provide that framework.

4.1 States shall ensure the equal right of men and women, and the equal right of boys and girls, to housing, land and property restitution.

The Court determined that, although there was comprehensive housing legislation in place aimed at the progressive realization of the right to housing, the legislation did not take into account the situation of people in desperate need.

Article 11 of the Covenant recognizes that housing is an essential element of the right of everyone to an adequate standard of living.

Regarding the right to housing, the Government reported that non citizens can apply for support from the State under the Law on State Support to Acquire or Rent Housing (N IX 1188 of 12 November 2002).

So is it me particularly that you would choose to deny the right to housing, the right to adopt children, the right to marriage, the freedom to shop here, live here, buy here?

The right to housing was, however, safeguarded by the Constitution and the Roma were recognized as a vulnerable group.

22.1 The international community should promote and protect the right to housing, land and property restitution, as well as the right to voluntary return in safety and dignity.

As a result, neither Roma nor other inhabitants of Dobšiná can claim a violation of their right to adequate housing or discrimination resulting from such resolutions.

Programmes were being implemented to provide housing loans, transfer housing to them and construct housing, albeit of a temporary nature, at times.

These included civil and political rights such as the right not to be tortured, freedom of association, and the right to non discrimination on the basis of sex, race, or ethnic origin and economic, social and cultural rights such as the right to adequate housing or the right to food.

Several witnesses stressed that these restrictions had deprived them of other essential rights such as their right to choose their residence, their right to an adequate standard of living, food and housing, their right to work, as well as their rights to health and education.

That stage was thus covered by the protections of the Convention, even though the resolution did not itself confer a directly enforceable right to housing.

10.6 The State party argues, in the second instance, that the municipal council's resolution did not confer a direct and or enforceable right to housing, but rather amounted to but one step in a complex process of policy development in the field of housing.
