The third part (articles 26 105) describes the organization and function of the State.

As regards the topic Responsibility of international organizations , the Commission considered the Special Rapporteur's third report (A CN.4 553), proposing nine draft articles dealing with the existence of a breach of an international obligation by an international organization and the responsibility of an international organization in connection with the act of a State or another international organization.

In accordance with transitional articles 3, 4 and 5 of the Federal Public Administration Organization Act, the Customs Administration is under the Ministry of Defence and the Ministry of Public Security.

Although the articles on responsibility of States do not expressly envisage that States aid or assist, or direct and control, or coerce an international organization in the commission of an internationally wrongful act, these cases appear to be analogous to those referred to in the above mentioned articles.
