Withdrawal from the Treaty

It notes that the integrity of the Treaty depends upon full respect by States parties for their obligations under the Treaty and deriving from the Treaty.

It is a matter of utmost importance to maintain the integrity of the Treaty and enhance the confidence, transparency and credibility of the Treaty process, possible only by acting in good faith and fulfilling the Treaty obligations.

The nuclear arsenal of those States which are not parties to the Treaty is a serious topic of concern, with regard to Article VI of the Treaty.

The announcement by the Democratic People's Republic of Korea of its intention to withdraw from the Treaty raises important challenges to the credibility and the functionality of the Treaty.

In order to determine the object and purpose of the treaty, the treaty as a whole must be interpreted in good faith in accordance with the ordinary meaning to be given to the terms of the treaty in their context.

In more modern times it is the character of the treaty, or of the particular provision in a treaty, which is regarded as the important element in determining the effect which an outbreak of war will have upon it.

The right to withdraw from the Treaty remains a sovereign right.

It is essential to further develop disincentives to withdrawal from the Treaty.

In this regard, Austria attaches particular importance to enhancing the performance of and accountability under the Treaty, in particular by submitting reports on the implementation of the Treaty to the meetings of the preparatory committee as well as to the review conferences.

The Review Conference should call on all States to sign and ratify it without delay and without conditions.

Given the interrelationship of the Treaty provisions, we would favour reports covering implementation of all aspects of the Treaty.

Under the general law of treaties as codified in the Vienna Convention, article 44, treaty suspension or termination applies only to the treaty as a whole, unless the treaty provides or the parties agree otherwise .

The Treaty must be made universal.

Furthermore, it is deplorable that the CTBT is still not in force nine years after its adoption. We therefore take this opportunity to encourage the 11 countries listed in Annex II of the CTBT to sign or ratify the Treaty, as appropriate, so that it can swiftly enter into force.

The object appeared to be the content of the treaty, while the purpose had to do with the end the treaty sought to achieve. Any reservation contrary to those two notions was not permitted.

After the treaty, Russia came to control the southern part of Karelia.

As of April 2014, 167 countries have ratified the treaty.

We continue to support the steady reinforcement of the CTBT verification regime in order to maintain momentum for the Treaty's entry into force.
