Whilst LOAC IHL makes provision for inter State claims for compensation, there is no express provision for individual claims.

Hospital provision and regulation is primarily a state and territory responsibility.

The State party has not entered any reservation to this provision of the Covenant.

This provision is directed both towards the State and the agencies of the minority group.

1. The application of a provision of the law of the State in which the assignor is located may be refused only if the application of that provision is manifestly contrary to the public policy of the forum State.

Thus the provision of a remedy by a State party negates the basis for the international claim.

Only one State, Algeria, reported that its legislation did not make such provision. Nine per cent of States did not answer the question.

A State or an international organization may not formulate a reservation to a treaty provision which sets forth a peremptory norm of general international law.

The State party should allocate sufficient funds to that effect and strengthen the role of non profit organizations in the provision of home care and other social services.

The same should apply to the provision in the articles on State responsibility (article 19) to the effect that the chapter now under consideration is without prejudice to the international responsibility, under other provisions of these articles, of the State which commits the act in question, or of any other State .

2005 OECD article 26 does not have a provision overriding any such dual criminality requirement in the transmitting State and the Commentary thereon does not refer to this issue.

(c) The State encourages the provision of additional social services to enable parents to combine the fulfillment of family responsibilities with their job and with participation in public life.

Where the domestic law of a State requires it to sell confiscated proceeds of crime or property and only permits it to share funds, this provision may be unnecessary.

(f) The State party should review its position under article 14 of the Convention to ensure the provision of compensation through its civil jurisdiction to all victims of torture

4.2 As regards the complaint related to article 16, the State party submits that it should be declared inadmissible, since this provision does not apply in the present case.

Further an extensive interpretation of article 5, paragraph 2, of the Covenant which would allow a State party to reintroduce the death penalty would run counter to this provision.
