Convention No. 100 Application of the principle of equal remuneration for work of equal value.

Drawing attention to the broad definition of remuneration contained in the Convention, which includes these types of remuneration, the Committee asked the Government how it ensured that discrimination in remuneration as between men and women for work of equal value does not occur for the types of remuneration excluded from the coverage of the Labour Act.

3.1 The author claims that the denial of an adequate remuneration for the work performed during his incarceration amounts to a violation of article 26 of the Covenant.

However, it allowed the legislator a transitional period, to run until 31 December 2000, to introduce an adequate raise in the remuneration of work as well as revised provisions for social insurance coverage of such work.

The travaux préparatoires of article 8 reveal that a proposal to include a right of prisoners to equitable remuneration for their work was rejected by the Commission on Human Rights.

The allowances were computed on the basis of the maximum annual remuneration of 160,000, the comparator remuneration figure since 1 January 2000.

Information was also requested on any practical measures taken to promote the application to all workers of the principle of equal remuneration for work of equal value for workers, in line with Article 2 of the Convention.

The Indian Code, for instance, requires disclosure about remuneration in a section of the annual report on corporate governance, in addition to suitable disclosure on director's remuneration in the profit and loss statement.

These Constitutional provisions to the right to work and be protected from discrimination are further enforced by legislation providing for non discrimination in employment, equal remuneration, benefits, and the health, safety welfare of employees.

These measures also follow upon Recommendation No. 14, which addresses the application of the ILO Conventions on non discrimination in the workplace and equality in remuneration for the same work of the same value, for women and men.

The right to remuneration is made in function of the amount and quality of work done, and competition for access to high ranking positions is in function of academic qualifications, experience, resulted obtained in previous work, employers' needs and the needs of the national economy.

In particular, he has not provided any information on the type of work that he performed during his incarceration and whether it was of a kind that is available in the labour market, nor about the remuneration paid for comparable work in the labour market.
