During the discussion on the prevention of genocide, the Special Rapporteur stressed the importance of achieving intellectual and cultural agreement on the need to prevent genocide.

In order to continue its consideration of subjects of general interest, the Committee held a thematic discussion on the prevention of genocide at its sixty sixth session, which was attended by your Special Adviser on the Prevention of Genocide, and adopted a declaration on this issue (see chapter VIII).

Recalling that 133 States Members of the United Nations have adhered to the Convention on the Prevention and Punishment of the Crime of Genocide, assuming the obligation to prevent and punish genocide, including war crimes and crimes against humanity,

Those objectives include, first and foremost, the prevention and punishment of the most serious international crimes, including genocide, crimes against humanity and war crimes.

It also did not ratify the Convention on the Prevention and Punishment of the Crime of Genocide or the Rome Statute of the International Criminal Court.

Assuming that general international law requires States and other entities to prevent genocide in the same way as the Convention on the Prevention and Punishment of the Crime of Genocide, and that the United Nations had been in a position to prevent genocide, failure to act would have represented a breach of an international obligation.

Adopts this declaration on the prevention of genocide for the consideration of the States parties, the Special Adviser, the Secretary General, as well as of the Security Council,

It welcomed the recognition by the 2005 World Summit of the international community's responsibility to protect populations from genocide, war crimes, ethnic cleansing and crimes against humanity, and reaffirmed its support for the Special Adviser to the Secretary General on the Prevention of Genocide.

In all 10 cases it invoked as a basis of the Court's jurisdiction article IX of the Convention on the Prevention and Punishment of the Crime of Genocide, which was adopted by the General Assembly on 9 December 1948 and which is known as the Genocide Convention.
