Land and property rights

States own land, mineral rights, and infrastructure.

The reports raise the issue of pastoral land rights from the point of view of access to forest and pastoral land.

The Constitution, Land Law and Law on Marriage and Family provide for equal rights of men and women over land (See Article 15).

In fact, women remain passive and have few opportunities in land allocation due to their lack of understanding of rights and responsibilities over land.

There is first the problem of environmental damage caused to the land of indigenous peoples, with an impact on the enjoyment of their land rights and with implications for a wide variety of their personal rights.

Oxfam International calls some of these deals land grabs. Its own report, Our Land, Our Lives,indicates that, since 2008, communities affected by World Bank projects have brought 21 formal complaints alleging violations of their land rights.

All too often, notions such as reserve agricultural land, or idle land, are manipulated out of existence, sometimes being used to designate land on which many livelihoods depend, and that is subject to long standing customary rights.

Finally, farmers rights need to be protected, the efficiency of land use must be increased, and policies for acquisition of rural land for urban use should be overhauled.

Custom land may, however, be leased, and people may buy and own leasehold rights for many years.
