Reform in the justice sector has progressed more slowly than hoped for, impacting on the fair and effective administration of justice.

These justice institutions have recently developed a collaborative and productive relationship institutionalized in the Justice Sector Consultative Group (JSCG), chaired by MoJ.

MINUGUA verified gradual expansion in bilingual education and in the accessibility of the justice sector to those speaking indigenous languages.

Budgetary resources required for the 2006 2008 support programmes in the justice sector are estimated to a total 10 million.

Some advisers would continue to perform line functions to support critical State institutions, particularly in the justice sector where their Timorese counterparts are undergoing legal training.

While efforts to reform the justice sector are under way, they remain nascent, and further commitment by the Government is required for recognizable progress to be made.

It will now form the basis for strengthening the EU Afghan partnership across a wide range of areas, including political and economic governance, security sector reform and justice sector reform, counter narcotics, development, human rights, civil society and refugee return, education and culture.

It remains essential to align justice sector activities under national laws that conform to international human rights standards and to ensure the implementation of norms in the administration of justice that promote and safeguard the rule of law for all without discrimination.

Although some prison reconstruction is under way through the efforts of UNODC and donors, more resources are required to keep pace with the ongoing reforms within the justice sector.

While noting that a reform of the legal sector has been undertaken and that the issue of access to justice is being considered, the Committee remains concerned about the difficulties of access to justice, especially for the poor and members of minority groups (arts. 5 and 6).

Domestically, with the support of international funding institutions, the Kenyan Government was undertaking sector wide reforms to promote good governance, the administration of justice and the protection of human rights.

In the new context of international relations, local authorities, civil society and the private sector would play a larger role in a globalizing, decentralizing society seeking justice and equal opportunities.

This framework has paid particular attention to (a) the differing capacities of central and provincial governments (b) linkages with the still developing justice sector and (c) cooperation with neighbouring countries.

Starting from this sanitised part of the sector, the police and justice authorities are now in the process of dealing with trafficking in human beings in the non licensed sectors.

On justice sector reform, progress has been made with respect to the adoption of essential legislation, training of personnel and the rehabilitation of physical infrastructure, including courts and correctional facilities.

The rule of law is a necessary component of rebuilding trust and the new Government will need to revise the legal codes as a key element of reforming the justice sector.

Finally, throughout the transition, MINUGUA worked closely with the country team to ensure continuity on key technical assistance projects, especially on land issues, citizen participation, public security and the justice sector.

In that connection, it is important to recognize that there is a link between the disbanding process and other efforts such as justice sector reform, counter narcotics activities and community development.

Moreover, as noted in paragraph 23 above, UNDP continues to work with UNMISET in the training of professionals in the justice sector, in order to develop the capacity of the public administration.

Supporting inclusive political dialogue and ensuring that conflict is resolved through peaceful means are the highest priorities, as are security, access to justice, and a dynamic private sector that generates sufficient job opportunities.
