(e) Rule 110.5, Joint Disciplinary Committees, is amended by adding a new paragraph (c) to include matters pertaining to financial responsibility for gross negligence in the competence of the Joint Disciplinary Committee at Headquarters

It is expected that the sharing of information with staff members concerning decisions on disciplinary cases will not only raise awareness and enhance transparency in disciplinary matters, but also have a deterrent effect and thus enhance ethical conduct.

Failure to observe these strict standards of conduct renders the perpetrators liable to disciplinary action for serious misconduct as defined in section III of the Department of Peacekeeping Operations Directives for Disciplinary Matters Involving Military Members of National Contingents.

In paragraph 29 of that resolution, the Assembly noted that the Administrative Law Unit had the multiple functions of administrative review, appeals, disciplinary matters and advisory services.

Starting in 2002, two information circulars (ST IC 2002 25 and ST IC 2004 28) were issued that informed all staff of the Secretary General's practice in disciplinary matters.

Composition of Joint Disciplinary Committees

With regard to potential conflicts of interest, the Assembly noted that the Administrative Law Unit has the multiple functions of administrative review, appeals, handling disciplinary matters and provision of advisory services.

Individual disciplinary, financial and criminal accountability

(a) A standing Joint Disciplinary Committee is established and shall be available to advise the Secretary General at his or her request in disciplinary matters at Headquarters comparable standing committees may be established in the United Nations Office at Geneva, the United Nations Office at Vienna and such other offices as may be designated by the Secretary General.

(e) A monitoring disciplinary mechanism required to handle possible disciplinary proceedings that may arise against defence counsel after the end of the Tribunals' mandate.
