The Panel notes that Kuwait has restructured this claim unit since it was originally filed.

This instalment also includes one category C overlapping claim filed under the Palestinian late claims programme that was reviewed by the Panel as the merged E4 Panel had concluded its work programme.

Several families filed a claim in an Israeli court to defend their 4,500 m2 of land and their right to free access to it.

2.1 The author filed a workers compensation claim with the Deputy Commissioner of Worker's Compensation, for redress in respect of injuries he had suffered.

The E4 claimant Al Nuwaisib Building Requirement was originally considered in the eighteenth instalment of E4 claims where it had been considered as overlapping with a category C claim filed by a different individual claimant.

This claim was hugely misguided.

Based on the above, the Panel finds that the category D claim filed by the individual claimant was in respect of losses of the business of the E4 claimant and not in respect of a separate and unrelated business.

Gutierrez filed for divorce in November 2006, which was finalized in January 2008.

Her appeal was ultimately dismissed as having been filed outside the statutory deadline.

2.11 On 17 December 2002, a new application for humanitarian residence permits was filed.

The author subsequently filed a new application for reconsideration and it too was rejected.

If status was to be withdrawn, a new complaint was to be filed, giving new causes for action.

A preliminary examination of these claims also revealed that in some instances the Kuwaiti companies in question had filed separate claims with the Commission, which were being processed as E4 claims. That claim was even more far fetched.

A separate and amended indictment against the accused was accordingly filed on 23 February 2005.

On 10 May 2000, a third request under section 417 was filed, which was rejected on 24 November 2000.

In order to evaluate the extent to which the individual claimants might have asserted losses in connection with a Kuwaiti company that had filed a claim in category E , the D and E4 Panels requested that computer searches be conducted against the Commission's claims database from claims filed in category D and against claims for business losses filed by individuals for amounts less than USD 100,000 (category C claims).

7.5 As to the claim that the author was deprived of his right to cross examine a crucial prosecution witness, the Committee notes the State party's contention that he was afforded, and took advantage, of the possibility to cross examine the public officers who had also filed a complaint against him.
