59. With respect to all of the decrees referred to above, the Special Rapporteur observes that the legal basis on which they are decreed and promulgated derives from the provisions of article 42, paragraph 1, of the Provisional Constitution of the Republic of Iraq.

The cumulative effect of the promulgation and implementation of the decrees is a calculated attack on the dignity of the Iraqi population inasmuch as the barbaric punishments instil specific fears and general terror among the population through the horror naturally created by the prospect of the implementation of the decrees.

61. The Special Rapporteur has received reports alleging widespread implementation of the decrees.

The Special Rapporteur concludes that the decrees addressed above constitute flagrant and determined violations of Iraq apos s international human rights obligations in so far as they prescribe cruel and unusual punishments and in so far as implementation of the decrees compounds these violations by involving torture.

As Croatia was a predominantly Catholic country, most of such ceremonies were conducted within the Catholic tradition.

Ms. Staznik (Croatia), referring to civil and religious marriage, said that civil procedures took precedence over the religious ceremony.

Law 92 1967 contains the penalties imposed in case of violation of the presidential decrees implementing Security Council resolutions.

There is no doubt about the existence of the decrees, nor of their implementation the Government of Iraq publicly declares and advertises these facts.

Such decrees, and such an order, can in no way be said to be compatible with respect for human rights.

Such mentalities should change, not through decrees or convictions but by means of education, training and raising the population's awareness.
