A new law prohibited racial discrimination in the field of employment, and the penalties for engaging in employment discrimination on racial grounds had been increased from a maximum of one year to three years or more.

In the absence of any prohibition of discrimination in public service employment, the Committee requested the Government to provide information on the measures taken to ensure non discrimination in that sector, including at the stage of recruitment.

Prohibition of discrimination in employment and occupation. The Committee noted that section 3 of the draft Labour Code prohibits all discrimination in employment and occupation.

The Employment Contracts Act prohibits the employers, in hiring and entering into employment contracts, discriminate against persons applying for employment.

The Labour Act has outlawed discrimination on the basis of sex in most aspects of employment and the Income Tax Act has done away with sex discrimination in taxation by a series of amendments to the Act.

Existing public statistics, it is believed, do not provide enough relevant information to analyze the possibility of discrimination in employment or housing.

The Committee, recalling its general recommendation XXX on discrimination against non citizens, encourages the State party to ensure full practical implementation of legislation prohibiting discrimination in employment and in the labour market.

The Committee is concerned about the reported persistence of discrimination against persons with physical and mental disabilities, especially in terms of employment, social security, education and health.

With regard to other legislation, the Labour Act (Act 6 of 1992), has outlawed discrimination on the basis of sex in most aspects of employment, the Income Tax Act (Act 4 of 1981) has done away with sex discrimination by a series of amendments to the Act, and the Government of Namibia enacted the Married Persons Equality Act (Act 1 of 1996).

The General Statute of the Civil Service regulates all aspects of the civil service career (recruitment, promotion, training and retirement), without discrimination as to sex.
