On 22 August 2003 new legislation on sexual offences entered into force in Aruba, amending, extending or introducing penalties for sexual offences and a number of other related provisions.

A number of other investigations included all sorts of serious white collar crimes, as well as sexual offences.

A difficulty would arise where a State party which wished to initiate a complaint in relation to a number of offences had not accepted the jurisdiction of a court in relation to all those offences.

(c) To progressively restrict the use of the death penalty and reduce the number of offences for which it may be imposed

Federal and international investigations had been launched against two foreign nationals suspected of organizing terrorist activities and committing a number of other offences.

While some agreed that it had been able to report a number of criminal offences, others felt that the picture was incomplete.

INPEC recorded a large number of disciplinary investigations, including offences committed in the line of duty as well as those constituting cruel, inhuman or degrading treatment.

These ordinances are Offences against Property (Enforcement of Hudood) Ordinance, 1979 Offences of Zina (Enforcement of Hudood) Ordinance, 1979 Offences of Qazf (Enforcement of Had) Ordinance, 1979 and Execution of the punishment of Whipping Ordinance, 1979.

This Act guarantees the protection of victims against many types of offences including sexual offences according to the Penal Code.

Several indictments filed during 2004 included organized crime offences as well as trafficking offences.

The Penal Code combines the offences of procuring and pimping in one article, even though they are separate offences.

(b) To make these offences punishable by appropriate penalties which take into account the grave nature of these offences.

In 2002, the Victims of Offences' Rights Regulations, 5762 2002 ( Victims of Offences' Rights Regulations ), further implementing the Law, were promulgated.

In the period from 2002 to 2003 in the RS, the number of 332 criminal offences of family violence was registered, and filed 313 criminal charges with the competent prosecutor's office.

Category D is for persons held in preventive detention in connection with political offences and persons convicted of political offences.

Under no circumstances may extradition be stipulated for political offences, even where common crimes are the result of such offences ,

Grave offences are premeditated offences punishable by deprivation of liberty for more than five years but not exceeding 10 years.

Especially grave offences are premeditated offences punishable by deprivation of liberty for more than 10 years or the death penalty.

In the light of the new legislation and the reduction in the number of capital offences, she wondered whether any persons convicted under the old legislation had been given more liberal sentences.

The Victims of Offences' Rights Law, 5761 2001 ( Victims of Offences' Rights Law ) and regulations are gradually assimilated into the various relevant bodies.

With regard to police custody for terrorist offences, the legislature has granted relatively long periods of custody in view of the nature and gravity of such offences and in order to take account of the exigencies of investigations into such offences.

Less grave offences are premeditated offences punishable by deprivation of liberty for more than three years but not exceeding five years and offences committed through negligence and punishable by deprivation of liberty for more than five years.

This court consists of a president and an appropriate number of vice presidents and justices. It has competence for hearing appeals relating, inter alia, to hadd offences offences for which the prescribed penalty cannot be altered in any way , qisas offences for which the penalty is retaliation and criminal, civil, commercial and personal status and inheritance cases. The Higher Council of the Judiciary establishes the divisions of the Court and decides on their areas of competence.

New legislation on sexual offences

35. Whilst existing international conventions are the most reliable source of international law from which to identify specific penal norms, existing treaties create quot criminal offences quot in a number of different ways.

Its divisions hear, inter alia, hadd offences, qisas offences and criminal, civil, commercial, personal status and inheritance cases.

3. The offences established in accordance with article 5 of this Protocol shall be regarded as offences established in accordance with the Convention.

The Code follows the approach of bilateral conventions and does not place restrictions on the kinds of offences which can be classified as extraditable offences.

The offences of terrorism and related acts are introduced into the category of serious offences, making it impossible for release on bail to be granted.

(b) The lack of proportion between the high number of reports of torture and ill treatment and the very small number of convictions for such offences, as well as the unjustifiable delays in the investigation of cases of torture, all of which contribute to the prevailing impunity in this area

Offences that do not pose a great danger to society are premeditated offences punishable by deprivation of liberty for not more than three years and offences committed through negligence and punishable by deprivation of liberty for not more than five years.
