An amendment shall enter into force 90 days after the depositary has received the notification of its acceptance.

The Secretariat has also received notification from the Depositary regarding ratification of the Beijing Amendment by the following Parties Cuba, Ireland, Kyrgyzstan and Romania. This brings the number of ratifications of the Montreal Amendment to a total of 136 and the number of ratifications of the Beijing Amendment to101.

Since 19 October 2005, the Secretariat has received from the Depositary notification of additional ratifications of the Montreal Amendment by the following two Parties Cuba and Ireland.

3. Notification of a subsequent assignment constitutes notification of all prior assignments.

After the depositary informs the Council that the requirements for entry into force of the amendment have been met, and notwithstanding the provisions of paragraph 2 of this article relating to the date fixed by the Council, a member may still notify the depositary of its acceptance of the amendment, provided that such notification is made before the entry into force of the amendment.

The proposed amendment shall be adopted by the Council of Members, in accordance with article 9 of the Agreement, and shall enter into force for all Members 90 days after the depositary has received notification of the decision of the Council of Members.
