(e) Administration of justice secretariat services to the Joint Appeals Board Joint Disciplinary Committee, Vienna, processing of Board Committee recommendations on appeals and disciplinary cases.

On 25 February 2002, the Aliens Appeals Board upheld the decision of the Migration Board.

2.7 Before the Aliens Appeals Board, the complainant contested the findings of the Migration Board.

On 2 September 2002, the Aliens Appeals Board dismissed the appeal, endorsing the assessment made by the Migration Board.

(ii) Preparation and submission of respondent's reply to appeals filed before the Joint Appeals Board and representation of the Secretary General at a panel for hearings

The Aliens Appeals Board made a study tour to Bangladesh in October 2002.

An appeal in respect of such a decision may not be submitted to the Joint Appeals Board.

4.6 On 27 February 2001 the complainant lodged an appeal with the Aliens Appeals Board.

The complainant has described his political activities in detail before the Migration Board and the Aliens Appeals Board, and neither institution questioned his activities.

(ii) Review of requests by staff for administrative review preparation and submission of respondents' replies to appeals filed with the Joint Appeals Board and representation of the Secretary General at panels for hearings

If the Migration Board refers a case, it must first be forwarded to the Aliens Appeals Board which provides its own opinion on the case.

However, on 19 December 2002, the Aliens Appeals Board denied the application for a stay of execution of the expulsion order.

Two new applications for a resident permit on humanitarian grounds were subsequently denied by the Aliens Appeals Board.

His asylum application was rejected by the Swedish Migration Board on 21 February 2001 and his appeal of that decision was rejected by the Aliens Appeals Board on 3 June 2002.

(ii) A payment against the biennium 1998 1999 of 50,853 to a UNIDO staff member as recommended by the Joint Appeals Board

That function is temporarily carried out by the Secretary of the Joint Appeals Board, which may potentially lead to a conflict of interest.

In paragraph 179, the Board recommended that UNICEF allocate emergency funding to field offices in the context of appeals or other validated plans.

The source further mentions that the United States Government appealed the decision of the immigration judge to the Board of Immigration Appeals (BIA) on 12 November 2002.

For that purpose, a new P 3 post for the Secretary of the Joint Appeals Board Joint Disciplinary Committee with part time administrative support is proposed.

There is an urgent need to establish a Panel of Counsel at Nairobi, given the fact that a Joint Appeals Board is operational at that duty station but there is no legal assistance or counsel for staff with pending appeals or disciplinary cases.

While asylum claims are normally dealt with by the Migration Board and, in turn, the Aliens Appeals Board, under certain circumstances either body may refer the case to the Government, while appending its own opinion.

10.4 On 15 June 2004, the Aliens Appeals Board granted the complainant's wife and her five children permanent resident status in Sweden on humanitarian grounds.

In September 2002, the complainant filed a new application with the Aliens Appeals Board in which he asserted that an enforcement of the expulsion order would be inhumane.

Those efforts include public speeches by the President and Prosecutor, and written appeals by the Registrar are fully documented and have been provided to the Board of Auditors.

(i) A charge of 3,000 for the biennium 1996 1997 in respect for a payment made to a UNIDO staff member as recommended by the Joint Appeals Board

Peru stresses the importance of the work of the Fund's Board of Directors and appeals to those States that are in a position to do so to contribute to the Fund.

Appeals

However, a separate case was pending before the Aliens Appeals Board concerning a Bangladeshi woman who had arrived in Sweden in September 2002 and applied for asylum.

Serving as member of the Local Committee on Contracts, Local Survey Board, Ad hoc Disciplinary Committee, Chairman of the Classification Appeals Committee and other ad hoc bodies set up by the Administration.

Defenders from non governmental organizations, such as the Greek Council for Refugees, provided services free of charge. NGO representatives also participated in the work of the Appeals Board which reviewed asylum applications.

5.5 Regarding the argument that the complainant presented insufficient evidence to support his claims, counsel submits that in the proceedings before the Aliens Appeals Board, he requested a medical forensic and psychiatric examination, but the Board did not consider this to be necessary.

On 13 November 2001, the Aliens Appeals Board, whose view the Government had sought, shared the Migration Board's assessment of the merits and also considered that the Government should decide the matter.

So far the secretarial support and services to the Joint Appeals Board Joint Disciplinary Committee, Vienna have been provided on a part time basis by staff of the Human Resources Management Service.

As the Appeals Chamber's workload increases, consideration is still being given to increasing the capacity of the Appeals Chamber by having two Benches of five Judges available for the disposition of appeals.

All of their appeals concerning the issuance of visas are pending before the United States Eleventh Circuit Court of Appeals.

Complementarity of functions related to appeals

They have been and will continue to result in increased efficiency of appeals proceedings before the Appeals Chamber.

13.8 The Committee observes that, in the normal course of events, the State party provides, through the operation of the Migration Board and the Aliens Appeals Board, for review of a decision to expel satisfying the requirements of article 3 of an effective, independent and impartial review of a decision to expel.

Appeals against this decision were dismissed by the Appeals Chamber on 24 September 2003.
