It was clearly understood that, while norms of jus cogens and obligations arising under Article 103 of the Charter addressed aspects of hierarchy, obligations erga omnes were more concerned with the scope of application of norms, rather than hierarchy.

The more human rights norms and standards expand in scope the broader the application of the requirements of the principles of humanity and the dictates of public conscience .

Another important aspect of this Amendment is the provision to allow, for example, a more direct application of international norms and conventions to protect human rights ratified by Brazil.

In any case, regional human rights regimes may also be seen as the varying, context sensitive implementation and application of shared standards, and not as exceptions to general norms.

Advocacy of norms

It was also noted that norms of jus cogens, obligations erga omnes, and obligations under the Charter of the United Nations (Article 103 of the Charter) should be treated as three parallel and separate categories of norms and obligations, taking into account their sources, their substantive content, territorial scope, and practical application.

It is for that reason that Canada welcomes the Special Representative of the Secretary General's call for an era of application to pursue the practical and daily implementation of the norms already adopted.

Several speakers expressed their countries' support for the efforts of the United Nations to develop and disseminate standards and norms in criminal justice and to assist States in their use and application.

Of course, such norms are helpful.

Development of new standards and norms

The delegation pointed out that, in order to maintain maritime security, States had to act strictly in accordance with international law, avoiding the application of any unilateral policies in contravention of existing legal norms derived from the Convention.

Speakers also emphasized that the use and application of United Nations standards and norms in crime prevention and criminal justice should continue to be accorded high priority, especially in relation to prison management and the human rights of prisoners.

At the same time, the Court, as the judicial organ of the United Nations, by exercising its jurisdiction and issuing advisory opinions, plays a vital role in the clarification, affirmation, application and development of the norms and principles of international law.

Compliance with peremptory norms

Despite efforts to create a legal framework to protect seas and oceans, lacunae still exist both in the application and enforcement of international rules and norms, and in the understanding by the principal actors and the public of the problem.

Ms. Hampson stated that standard setting was not only about creating binding legal norms, but also about creating standards or guidelines for the implementation of these norms, which played an important role in shaping the interpretation of norms.

A convention is a set of agreed, stipulated, or generally accepted standards, norms, social norms, or criteria, often taking the form of a custom.

At its 8th and 9th meeting, on 26 and 27 May 2005, the Commission on Crime Prevention and Criminal Justice considered agenda item 8, entitled Use and application of United Nations standards and norms in crime prevention and criminal justice .

5.9 According to the author, the literal application of article 14 of the bilateral Agreement seems to disregard or nullify his acquired rights or those being acquired as a migrant worker, which contravenes various national and international norms proclaiming the principle of the protection of such rights.

Some members of the Study Group doubted that the principle of harmonization had a particular role to play in the relationship between norms of jus cogens and other norms.

We must address the underlying motives that drive States to acquire weapons of mass destruction, which include threats posed by superior conventional or non conventional forces, the existence of disputes and conflicts with more powerful States and discrimination in the application of international norms and laws.
