such humanitarian concerns as may exist in the international community, to which we belong, suggests the adoption of a new additional protocol on MOTAPM within the framework of the Convention, to read as follows

To determine basic categories of fuzes and adopt Best Practices on fuze mechanisms so as to increase the discriminatory capacity of MOTAPM to the greatest extent and to prevent them from being actuated by the presence, proximity or contact of a person.

The permitted purpose for which mines were used, the activity or project in which these mines were used, progress made or objectives realized in the use of these mines, the types and quantities of mines used and any other relevant information (e.g., the location of the use of the mines).

Strengthening post conflict demining efforts is the ultimate and most effective way to address the humanitarian concerns caused by MOTAPM. The civilian and humanitarian organization casualties inflicted by MOTAPM mainly occur in the post conflict period.

The nub of the MOTAPM problem lies in the way in which they are used, and not in their design.

Such MOTAPM will not constitute harm to persons.

These tragedies occur due to the easy availability of landmines.

The transfer of MOTAPM which do not meet the detectability requirement should be prohibited, except for the purpose of destruction or for development of and training in mine destruction, mine clearance, or mine destruction techniques.

It is a fact that the humanitarian concerns caused by MOTAPM mainly arise from two kinds of irresponsible use of MOTAPM one is the use of MOTAPM by non State actors the other is the absence of record and monitoring of the minefields.

This is sufficient to address the humanitarian concerns caused by AHD and States Parties should strictly implement this stipulation.

(ii) The omission of an unambiguous responsibility for the users of MOTAPM to clear (or maintain) the weapons after the end of active hostilities.

The transfer of MOTAPM to States, which have not accepted the provisions and restrictions, as proposed in the present paper, should be prohibited.

Mines Other Than Anti Personnel Mines (MOTAPM)

The ICRC considers these mines to be anti personnel mines and banned for those States which are party to the Convention on the Prohibition of Anti personnel Mines.

China holds the view that the biggest difficulty in post conflict demining operations is the clearance of the MOTAPM minefields emplaced by a State on foreign territory, as in most cases that foreign State where the minefields are located has little knowledge about the function of the MOTAPM emplaced as well as the most effective method to clear them.

The Ottawa Convention was the leading international instrument in the fight against anti personnel mines.

The teams provided mine risk education to 1,978 people.

In total, the teams provided mine risk education to 6,890 persons.

(d) Landmines other than anti personnel mines

One could understand the phrase to mean that if a State Party does not intend for its MOTAPM to be cleared by humanitarian mine clearance organizations, its mines would not have to meet the detectability requirement.

These include the prohibition to direct mines against the civilian population and civilian objects, the prohibition on the indiscriminate use of mines and other important rules of international humanitarian law.

However, the use of such MOTAPM within a State's own territory should not be bound by this prohibition.

The Panel notes that nationals of Kuwait who were victims of mines and ordnance explosions did not file individual claims for medical expenses, as the Government of Kuwait incurred these expenses.

Working Group on Mines Other Than Anti Personnel Mines

China believes that in the pre war period, minefields should be monitored and guarded effectively, but need no marking or fencing in the post war period, however, minefields should be marked and fenced immediately.

Taking into account the views of other parties on this issue, China is ready to demonstrate flexibility by making some amendment to the provisions on the first category of sensitive fuzes in the Coordinator's Paper, i.e., tilt rods do not appear to be a recommended method of activation, if it cannot be designed in such a way that an individual cannot, within reason, initiate the mine .

It encourages the Government to continue the process of de mining, as well as to continue its efforts to prevent and limit risks to the population especially to displaced and returned persons and to strengthen mechanisms for assisting victims of anti personnel landmines.

Paragraph 13 The exclusion contained in this paragraph would allow the parties to a conflict to use non detectable MOTAPM if they are placed in perimeter marked areas.

A State which has emplaced MOTAPM minefields outside its own territory and the manufacturing State of the emplaced MOTAPM have the obligation to assist the State where such MOTAPM minefields are located in clearing the minefields as soon as possible upon cessation of the conflict.

(ii) To prohibit the use of MOTAPM, which are not detectable by commonly available mine detection equipment.

China hopes that the Coordinator on the MOTAPM issue will incorporate proposals in this package solution to his Paper, so as to facilitate further discussions on the issue in the GGE.

The additional requirements under this heading related to the increased costs of mine detection and mine clearing services under a memorandum of agreement as replacement for services previously provided by a demining contingent.

This would make the standards for PMAs in the MOTAPM instrument consistent with those recognized for such areas in Amended Protocol II.

Owing to the age of the mines and their deteriorating explosives, this threat has increased.

Millions of anti personnel mines remain in our countries. They constitute an obstruction to agriculture and development and have caused numerous casualties.

Requiring all MOTAPM to be detectable is an important measure to help mine clearance organizations locate and clear dangerous areas quickly and safely.
