(a) The reservation is prohibited by the treaty

Once again it can be said that such a reservation states the obvious.

5.3 The author challenges the German reservation as being incompatible with the character of article 26 as an autonomous right to equality free from any limitations inherent in accessory non discrimination clauses, such as article 14 of the European Convention on Human Rights.

However, there has recently been some reservations and banning of articles!!!

Tables of conservativeness factors This appendix provides two sets of tables of conservativeness factors to be used in the calculation of adjustments to ensure that adjusted estimates are conservative, in accordance with paragraphs 51 and 52 of the technical guidance.

To assess the compatibility of a reservation with the object and purpose of a general treaty for the protection of human rights, account should be taken of the indivisibility of the rights set out therein, the importance that the right which is the subject of the reservation has within the general architecture of the treaty, and the seriousness of the impact the reservation has upon it.

That was suggested by the very title of article 19, since the fact that a reservation was formulated did not mean that it was made , i.e. that it would actually produce effects.

4.3 The State party argues that there is no indication that the reservation itself is inadmissible.

An incompatible reservation would be null and void, irrespective of the reaction of other States parties.

Compliance with article 19 was one of the conditions for the validity of a reservation, but it was not the sole condition, and it therefore seemed that neither the permissibility school (which focused on article 19 to the exclusion of all other considerations) nor the opposability school (which was interested solely in article 20) provided an account of the legal regime of reservations in all its enormous complexity.
