Questions of responsibility of the European Community for conduct held by member States were discussed by the European Court of Justice.

The only institution that does have that power is the European Court of Justice in Luxembourg.

The obligations of Turkey had been clearly affirmed by a series of rulings of the European Court of Human Rights.

For example, a number of Member States contested the ability of the EC to join the European Convention on Human Rights before the European Court of Justice.

The powerful European Court of Justice (ECJ), in particular, has frequently been criticized for using European law to disguise an integrationist agenda.

He pointed out that the European Court of Human Rights had ruled that non registration of an association on the basis of its memorandum of purpose and its name was allowed under the European Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2001, the European Court of Human Rights had found Turkey responsible for numerous violations of the European Convention on Human Rights with respect to the enclaved Greek Cypriots in the northern part of Cyprus.

He had reportedly been given a 20 month suspended sentence by a military court in June 2003.

Indeed, in his speech, Cameron could not resist a passing shot at the European Court of Justice.

This approach implies making an exception for the relations between the European Community and its member States, to the effect that, in the presence of a European Community act binding a member State, State authorities would be considered as acting as organs of the Community.

The apparent difference could well be a sign of indirect discrimination in terms of the Convention and the rulings of the European Court of Justice.

Under European case law and in accordance with a decision of 3 December 1992 handed down by the Court of Justice of the European Communities, a judicial remedy should be granted even where not provided for by domestic procedure.

Another possible combination of the conduct of an international organization with that of its member States occurs when the organization is under an obligation to achieve a certain result, irrespective of whether the necessary conduct will be taken by the organization itself or by one or more of its member States.
