He had no further meetings with either leading or junior counsel prior to the trial.

(b) Junior counsel was also representing the fourth co defendant in the same trial

Neither counsel nor the author contended at the trial that he had not been cautioned.

If counsel felt that they were not properly prepared, it was incumbent on him to request the adjournment of the trial.

Similarly, prior to the re trial, the attorney assigned to defend him only consulted with him for a limited amount of time on the day of the opening of the re trial he adds that this attorney never visited him in prison prior to the re trial.

He was not approved by either Mr. Choi or his family, who were given no opportunities to consult with the attorney before the trial.

Thus, with regard to Dennis Douglas apos case, it is submitted that he only met with junior counsel on two occasions prior to the trial.

As a last resort, counsel wrote to the Minister of Justice, asking him to order the prosecutor to initiate proceedings in the case.

Similarly, it does not transpire from the trial transcript that counsel was appointed against the author's will or that he limited his interventions during the remainder of the trial to redundant pleadings.

Counsel opines that this situation should prompt the Norwegian high courts to give special attention to ensuring a fair trial for coloured defendants.

The Committee notes, however, that in the present case the author would not have been allowed, unless special circumstances could be shown, to raise issues on appeal that had not previously been raised by counsel in the course of the trial.

It was not until one month prior to the trial that he was assigned a legal aid attorney, who did not consult with him, despite an earlier adjournment for that purpose, until the day before the start of the trial and then only for 40 minutes

The advocate? What?

It is sometimes entrusted to non professionals, preliminary investigations and pretrial proceedings are often conducted without a lawyer, and court appointed lawyers for the actual hearing are generally told what cases they are to defend only hours or days before the trial.
