The Convention entered into force on May 17, 2004.

It covers all core customs procedures, and provides for transparent and simple processes.

These activities focus on three main objectives mobilization of resources for the core activities under the Convention, broadening the funding base for implementation of the Convention and information systems, knowledge sharing and communication strategy.

Ukraine declared, in relation to article 13, paragraph 6, of the Convention, that the Convention shall be applied only subject to the observation of the constitutional principles and fundamental basis of the legal system of Ukraine.

Building of partnerships for the implementation of the NAP process is one of the central provisions of the Convention and its regional implementation annexes.

Under Article 15 entitled Implementation of the Convention , each Party is required to take such measures as may be necessary to establish and strengthen its national infrastructures and institutions for the effective implementation of the Convention.

In this field, it would be wise to adhere to some basic rules from which the convention as currently drafted appears to be diverging.

Every ratification of the draft convention, even if some States initially felt the need for a more conservative approach, extended the reach of the basic rules of electronic commerce, and that in turn would contribute to ratification by yet more States.

Protocol no. 12 to the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) provides for a broader basis for the ban on discrimination contained in the Convention.

Article 14 of the ECHR provides that the enjoyment of the rights and freedoms set forth in the ECHR shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.

Pursuant to Article II, paragraph 2 Rights and freedoms are envisaged in the European Convention for Protection of Human Rights and Fundamental Freedoms and its Protocols that are directly applicable in Bosnia and Herzegovina.

Ironically, the pact even limits market competition to protect powerful special interests, undercutting the core principles of free trade.

He pointed out that the European Court of Human Rights had ruled that non registration of an association on the basis of its memorandum of purpose and its name was allowed under the European Convention for the Protection of Human Rights and Fundamental Freedoms.

The Customs Administration is a member of the World Customs Organization (WCO) and has been implementing the Convention on the Harmonized Commodity Description and Coding System since 25 September 1993.

3.4 The authors support this conclusion by referring to articles 8 and 12 of the European Convention on Human Rights and Fundamental Freedoms, although they regard these provisions as providing a lesser protection than the Covenant.

If parties chose to derogate from the draft convention's provisions on form requirements, they should be free to do so, since the underlying legal requirements would be set forth in domestic law.

She urged the Government to overcome its reservations to the Convention and to do more to support women wishing to participate in politics and public life, including by creating infrastructure.

In its response to the brief questionnaire on basic reporting obligations, El Salvador stated that extradition was conditional on the existence of a treaty and that it took the Convention as the legal basis for cooperation on extradition with other States parties.

The annex to the present Convention forms an integral part of the Convention.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.

Each State Party shall also consider adopting appropriate legislative and administrative measures, consistent with the objectives of this Convention and in accordance with the fundamental principles of its domestic law, to prescribe criteria concerning candidature for and election to public office.

25. We are convinced that asset recovery is one of the essential components of the United Nations Convention against Corruption and, for that reason, we emphasize the need to adopt measures to facilitate asset recovery that are consistent with the principles of that Convention.
