All persons or groups whose property has been seized or whose assets have been frozen have the right to challenge this through full and fair legal proceedings, which, owing to the gravity of seizing property or freezing assets in democratic societies and the principle of the presumption of innocence, must be compulsory.

The Party transferring the proceeds of crime or property assumes no liability or responsibility for the proceeds of crime or property once they have been transferred and relinquishes all right or title to and interest in the transferred proceeds of crime or property.

The instrument covers three categories of crimes crimes against the person, crimes against property and types of (transnational) organized crime.
