To adopt a decision on the payment mechanism and the priority of payment of outstanding claims (S AC.26 Dec.256 (2005)).

As indicated above, a decision was taken at this session to modify the payment mechanism and the priority of payment of outstanding claims.

However, a lump sum payment of 65,200 was received this year, reducing the outstanding amount to 1,807.

Other Member States in arrears are encouraged to consider submitting payment plans to steadily reduce their outstanding assessed contributions.

Noting also that following the last round of payment made on 27 October 2005, there remain 85 claims with payments outstanding,

Having concluded also that expediting payment of this claim will not significantly alter the timing of payments to other claimants being paid through the current temporary payment mechanism.

The Panel finds that the other components of the claim for the payment of relief are not compensable.

Decision concerning the expedited payment of United Nations Compensation Commission claim number 4002126 (S AC.26 Dec.255 (2005))

Table 4 shows, in summary form, the current status of those Member States that have entered into payment plan arrangements to settle outstanding assessed contributions.

It is noted that the Secretariat has maintained its efforts to collect outstanding assessed contributions and negotiated four new payment plans with member states during 2004.

Both Georgia and the Niger had payments and credits applied to their outstanding assessed contributions in 2004 that exceeded the amounts foreseen in their payment plans.

(c) If upon payment of the amounts referred to in sub paragraphs (a) and (b) above on any claim, that claim will have a remaining balance of 100,000 or less, the Executive Secretary may pay the full remaining balance of the claim

The claimant asserted his claim on the category D claim form as follows USD 112,600,000 for loss of tangible business property, USD 54,725,600 for loss of business income and USD 3,675,000 for payment of relief to others.

The Committee also encouraged the Comoros and Iraq to consider presenting a multi year payment plan as a way of gradually reducing their outstanding assessed contributions to the United Nations.7

Nevertheless, Member States should authorize the Secretariat to apply outstanding credits to outstanding assessed contributions.

After the last payment of approximately 655 million on 27 October 2005, there are only 85 approved claims (in categories D, E and F), with an outstanding award balance of 32.4 billion, that have not been paid in full.

As the six partners made the initial sale payment but not the final payment, the four partners successfully sued them for final payment.

In a judgement dated 5 July 2001, the Barcelona Provincial Court upheld the earlier ruling, albeit limiting the payment to the amounts outstanding for the period from August 1994 to 27 October 1995, the date of submission of the complaint.
