A. Draft Statement of Principles and Commitments

Turning to the text of the draft principles, the draft preamble was self explanatory. It contextualized the draft principles within the relevant provisions of the Rio Declaration on Environment and Development, in particular principles 13 and 16.

In discussing the draft resolution before us, New Zealand would like to highlight two core principles.

Since the main objective of the draft principles was to provide guidance for States in the settlement of disputes concerning environmental damage, some delegations considered it most appropriate to include a provision on dispute settlement in the draft principles.

Thus, the same threshold of significant , applicable in the case of the draft articles on prevention, was also applicable in respect of the draft principles.

The present draft principles apply to transboundary damage caused by hazardous activities not prohibited by international law.
