As a result of the last round of comments received, several minor editorial changes were incorporated into the draft decision guidance document.

The Conference of the Parties decides whether the chemical should be removed from Annex III and whether to approve the revised draft decision guidance document.

In particular, guidance would be welcome on how duplication of claims or recovery could be avoided in circumstances, as suggested in the commentary to draft principle 1, where liability under the draft principles might arise concurrently with State responsibility.

Since the main objective of the draft principles was to provide guidance for States in the settlement of disputes concerning environmental damage, some delegations considered it most appropriate to include a provision on dispute settlement in the draft principles.

It was suggested that the language contained in draft article 3 (2) as set forth in A CN.9 WG.III WP.44 could provide useful guidance to clarify this matter.

By its decision 21 CP.7, the COP forwarded to COP MOP 1 a draft decision on good practice guidance and adjustments under Article 5, paragraph 2, of the Kyoto Protocol.

In response to the above request, the Secretariat prepared the draft guidance for the review and updating of national implementation plans, which is contained in the annex to the present note.

The draft decision guidance document is distributed as a meeting document (in the six official languages of the United Nations) for discussion at a Chemical Review Committee meeting for finalization and approval.
