The court s decision thus is an affirmation of Indian pluralism and of the rule of law.

The decision will remain unfair and unpredictable and consequently the rule of law will not prevail.

In such cases, the court will not rule pending a decision by the Constitutional Court within 30 days.

Together with the proposed decision, the Chair shall provide, subject to the applicable confidentiality requirements, the relevant facts that, in the Chair's judgement, justify decision making pursuant to this rule 30.

In addition, since the Covenant prevailed over domestic law, any rule or decision contrary to the Constitution or to article 4 of the Covenant would be inapplicable.

The first imposed the rule of unanimity within the European Union for any decision regarding foreign policy or the use of armed force for other than humanitarian purposes.
