Desiring to remove legal obstacles to the use of electronic communications in international contracts, particularly those which are subject to the Convention on Contracts for the International Sale of Goods.

The United Nations Convention on Contracts for the International Sale of Goods (CISG the Vienna Convention) is a treaty that is a uniform international sales law.

The Acting President Draft resolution II is entitled United Nations Convention on the Use of Electronic Communications in International Contracts .

Scope of Application of the Draft Convention on the Use of Electronic Communications in International Contracts and its possible impact on Hague Conventions

It is not clear, however, whether matrimonial property contracts under this Convention would be covered by the E Contracting Convention.

The present document reproduces the first comments received by the Secretariat on the draft convention on the use of electronic communications in international contracts.

Hereby offers the following views and suggestions with respect to the draft Convention on the Use of Electronic Communications in International Contracts (hereinafter referred to as the draft Convention ) (A CN.9 577)

Mr. Shin (Republic of Korea) said that his delegation welcomed the finalization of the draft convention on the use of electronic communications in international contracts.

The failure of the United Nations Convention on Contracts for the International Sale of Goods to be specific in that regard has generated substantial disagreement.

The Working Group approved the draft convention on the use of electronic communications in international contracts at its forty fourth session (Vienna, 11 22 October 2004).

2. Commends the Commission for the finalization and approval of a draft convention on the use of electronic communications in international contracts Ibid., chap. III and annex I.

In line with article 86 of the United Nations Convention on Contracts for the International Sale of Goods, such consignee when taking delivery from the carrier does so on behalf of the seller.

The Commission's most important achievement during the past year had undoubtedly been the approval of the draft convention on the use of electronic communications in international contracts, aimed at enhancing legal certainty and commercial predictability where electronic communications technology was used in relation to international contracts.

Second, regulations on work contracts are also very liberal.

I am pleased to note that draft resolution II under this agenda item contains the annex to the United Nations Convention on the Use of Electronic Communications in International Contracts.

The Chairman introduced the draft resolution on the draft United Nations Convention on the Use of Electronic Communications in International Contracts (A C.6 60 L.8), which had been prepared by the Bureau.

This group has, at its forty four meetings, worked hard to produce a number of documents relating to electronic commerce, including the draft convention on the use of electronic communications in international contracts. The group started work on that convention in March 2002, continuing until October 2004.

There was support for the view that the draft convention should permit the untrammelled enforceability of arbitration agreements in contracts of carriage.

On the other hand, paragraph 10 of the Note states that The Commission noted, in particular, the proposal that the Working Group's considerations should not be limited to electronic contracts, but should apply to commercial contracts in general, irrespective of the means used in their negotiation. Although the focus of this statement is on the means of communication used, it seems to be based on the assumption that the Convention would apply to commercial contracts only.
