However, the reality is that the Executive Board will more often than not decide these matters.

The Executive Secretary reports to the Secretary General on administrative and financial matters through the Under Secretary General for Management and on substantive matters through the Under Secretary General for Economic and Social Affairs.

The recommendation by the Executive Board and the decision by the COP MOP on such a case shall be made public.

The chain of accountability runs from the Managing Director to the IFAD President to the COP.

The Managing Director submits periodic reports to the COP on behalf of the IFAD President.

The Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol (COP MOP) shall have authority over and provide guidance to the clean development mechanism (CDM).

The Executive Secretary provides advice and support to the President and the Bureau of the COP and the COP MOP, and to other presiding officers.

The Executive Secretary located in Geneva will be appointed by the Executive Director of UNEP and the Executive Secretary located in Rome will be appointed by the Director General of FAO, in consultation with the Conference of the Parties through the Bureau.

By its decision 23 COP.6, the COP requested the Executive Secretary to report to the COP at its seventh session on the status of the trust funds established under the financial rules of the COP.

Meetings of the Executive Board held in conjunction with meetings of the COP, the COP MOP or their subsidiary bodies shall be held at the same location as the meetings of these bodies.

The COP invited the Executive Secretary to report at COP 7 on the performance of all the Convention's trust funds in 2004 and 2005.

The COP MOP shall elect an alternate for each member of the Executive Board based on the criteria in paragraphs 7 and 8 above.

The Executive Board shall make this information publicly available and include it in its reports to the COP MOP.

The COP recognized aspects of risks of third party claims against the Executive Board by amending the rules of procedure of the Executive Board to provide that decisions of the Executive Board taken through electronic voting shall be deemed to have been taken in Germany (see decision 12 CP.10).

The Executive Board may suspend and recommend to the COP MOP the termination of the membership of a particular member, including an alternate member, for cause including, inter alia, breach of the conflict of interest provisions, breach of the confidentiality provisions, or failure to attend two consecutive meetings of the Executive Board without proper justification.

A decision along these lines by the COP MOP would also assist the Executive Secretary in obtaining the active help of the Party concerned to have the matter resolved according to the mechanisms approved by the COP MOP rather than by a local court.

By its decision 23 COP.6, the COP requested the Executive Secretary to submit to the COP at its seventh session (COP 7) a programme and budget for the biennium 2006 2007.

The suspension or withdrawal is with immediate effect, on a provisional basis, once the Executive Board has made a recommendation, and remains in effect pending a final decision by the COP MOP.

The Executive Board shall undertake any tasks assigned to it by decision 17 CP.7, in accordance with the CDM modalities and procedures, and by any subsequent decision taken by the COP MOP.

Invites the Executive Director of the United Nations Environment Programme and the Director General of the Food and Agriculture Organization of the United Nations to appoint an Executive Secretary in consultation with the Conference of the Parties through the Bureau.

Action Following its discussion of the item, the COP MOP will be invited to take note of the report of the CDM Executive Board.

The President recalled that the CDM Executive Board had been instituted by the COP at its seventh session and had so far functioned under its authority.

The President also reminded Parties that several members and alternate members of the CDM Executive Board needed to be elected by the COP MOP at the session.

With this approach, the three draft decisions on guidance to the Executive Board of the CDM that were forwarded by the COP would be replaced with one text for adoption by the COP MOP at its first session.

Proposed amendments will be submitted jointly, for consideration and approval by the Conference of the Parties and the Council, by the Executive Secretary of the UNCCD and the CEO of the GEF after consultation and agreement between them.
