In this case, the annulment proceedings instituted before the Bordeaux Administrative Court of Appeal were still pending.

On the date that the complaint was submitted to the Committee, the appeal to the Bordeaux Administrative Court of Appeal against the judgement upholding the order to deport the complainant was still pending.

In January 2014 his case was under review by the Criminal Cases Review Commission, with the possibility of a later reference to the Court of Appeal.

During the period under review, there was a significant increase in the workload of the Appeals Chamber, with appeals of judgement in 10 cases, as well as 28 interlocutory appeals and 1 motion for review under consideration.

The author submitted a petition for review by the Supreme Court on 8 December 2003 and these proceedings were still pending as at 20 April 2004, the date of the submission of the State party's observations.

While this appeal was still pending before the Supreme Court, the Constitutional Court handed down a judgement in which it decided that a judge who indicted an accused could not participate in the judgement against the same accused.

On 13 December 2002, the case was heard by the high court of the Guadalajara de Buga judicial district, which rejected the complainant's application.

Justice Crennan dismissed the appeal.

They have been and will continue to result in increased efficiency of appeals proceedings before the Appeals Chamber.

In the Appeals Chamber four judgements were delivered.
