The remaining three decisions by the Referral Bench are currently pending appeal.

The international war crimes tribunals created by the United Nations Security Council for the trial of war crimes in the former Yugoslavia and Rwanda also create the same capacity in the appellate chamber, with no further right of review.

A new Supreme Court of the United Kingdom came into being in October 2009 to replace the Appellate Committee of the House of Lords.

The right of appeal to the Privy Council would not be abolished as there was no consensus on the need to create an appellate court as the apex of the judicial system.

On 13 December 2002, the case was heard by the high court of the Guadalajara de Buga judicial district, which rejected the complainant's application.

That book seizure had been the only such seizure, and was under appeal in the Court of Appeals.

Justice Crennan dismissed the appeal.

They have been and will continue to result in increased efficiency of appeals proceedings before the Appeals Chamber.

Singapore Singapore Court of Appeal

In the Appeals Chamber four judgements were delivered.

The appeal was heard by the same three judges who had convicted him and was dismissed on 17 July 2003.

Pre appeal procedures were completed during the reporting period, with a substantial number of pre appeal decisions being issued by the Appeals Chamber.

The result of the author's conduct was that both the Appeals Court and the Court of Cassation were deprived of the ability to consider the merits of the appeal.

On 14 March 2003, Mr. Morales Hernández exercised his right of petition to appeal to the Ombudsman's Office this appeal was also rejected.

We note that the Tribunal's completion strategy involves a three step process encompassing the completion of investigations, trials and appeals according to the time lines established by the Security Council in resolution 1503 (2003).

Pre appeal procedures were ongoing during the reporting period, with the Appeals Chamber granting a motion for the presentation of additional evidence pursuant to rule 115.

By a majority decision, the Appeals Chamber held that the remaining judges had erred in the exercise of their discretion and, accordingly, granted the appeals and quashed the impugned decision.6

The Appeals Chamber held that the impugned decision was without interlocutory appeal and that it lacked jurisdiction to consider the Appellant's Notice of Appeal.9

It should also be noted that appeals are normally lodged by both (in multi accused cases all) parties. Therefore, the real number of appeals is much higher than the number of judgements on appeal.

So far, the Referral Bench has granted six motions and only three are pending decision. One case, which was not appealed, has been referred to the Republic of Croatia and two have been referred to the War Crimes Chamber of the State Court of Bosnia and Herzegovina following the Appeals Chamber's affirmance of the Referral Bench's decisions.

The Appeals Chamber noted that the reasons for which the Trial Chamber had certified the appeal were unclear, as the matters contained therein appeared to relate to the admissibility of the diary as evidence, which should be dealt with by the Trial Chamber in accordance with rule 89 (C).
