Lack of a legislative framework and institutions to prevent racial discrimination and provide recourse to victims of discrimination.

From a legal standpoint, all the guarantees that prohibit discrimination against women are in place equality is guaranteed by the country's Constitution.

The essence of the multilateral system consists in two principles non discrimination and national treatment.

In particular, there was concern about the position of CEDAW and CERD as a result of the inclusion of non discrimination issues in the common core document.

The Committee recommends that the State party ensure that the lack of court cases on racial discrimination is not the result of victims' lack of awareness of their rights or limited financial means, individuals' lack of confidence in the police and judicial authorities, or the authorities' lack of attention or sensitivity to cases of racial discrimination.

At the time of ratifying the Convention, the Constitution had a guarantee not to discriminate against women (see article 1).

The Committee is concerned that, as noted by the State party, the Constitution is inconsistent with the non discrimination provision of the Convention.

In the absence of any prohibition of discrimination in public service employment, the Committee requested the Government to provide information on the measures taken to ensure non discrimination in that sector, including at the stage of recruitment.

The Government also reported that the Labour Act prohibits direct or indirect discrimination against job seekers and that, when an employee complains of discrimination, the burden of proof of non discrimination rests with the employer.

1.4 Within Government, there are more internal policies that provide for non discrimination.

The Committee recalls that the principle of non discrimination requires that the specific characteristics of ethnic, cultural and religious groups be taken into consideration.

(b) The absence or small number of complaints, prosecutions and convictions relating to acts of racial discrimination in the country.

The utmost importance was attached to the principle of non discrimination, and equal rights were therefore granted to all Italian and foreign detainees.

The principle of non discrimination was further reflected in article 4 of the Civil Code.

The third requirement is non discrimination, which is a general principle of human rights law and elaborated by, inter alia, the International Convention on the Elimination of All Forms of Racial Discrimination, which also covers discrimination on ethnic grounds.

But the case for non discrimination in trade is also a compelling one.

The distinction was thus merely semantic, since the term equality also meant non discrimination.

The Government also reported that the Law On migration of population consolidated the main principles of the Universal Declaration of Human Rights such as non discrimination.

Important parameters in that regard were the obligations to respect, protect and fulfil, as well as non discrimination, adequate progress, participation and remedy.

The creation of the Ministry of Women Development and the National Commission on the Status of Women is motivated by the desire to ensure that women suffer no discrimination.

However, in the absence of a declaration of statehood, Puerto Ricans faced considerable discrimination.

The principle of non discrimination applies to virtually all aspects of a State's treatment of individuals in connection with its counter terrorism measures.
