This provision, as per superior court's observation is the equivalent of the doctrine of rule of law .

All four had been on the initial commission of inquiry set up to investigate Dr. Manlan's killing.

On 17 December 2002, the Supreme Court, by a majority of 11 to 6, overturned the conviction.

2.3 In a judgement dated 27 January 1999, the Supreme Court rejected the application for annulment.

Following the Supreme Court decision, the Director of Public Prosecutions expressed the view that, in light of the Supreme Court's decision, Norway would be a safe haven for Nazi marches, due to the prohibition on such marches in neighbouring countries.

There was thus a delay of two years and eight months between the last appeal brief and the Supreme Court's judgement.

3.2 Specifically, the author considers that the Supreme Court judgement in his case is incompatible with article 27 of the Covenant.

On 12 November 2002, the Danish Board of Appeal rejected the author's application for leave to appeal against the High Court's judgement.

The author observes that in his case the State party cited the text of a Supreme Court judgement in which it was expressly noted that both the Supreme Court and the Constitutional Court lacked competence to make a fresh appraisal of the facts and evidence.

He argues that remaining remedies are futile, as the District Office decided against the spirit of the decision of the Constitutional Court, and that a judgement by the Supreme Court could only overturn a decision from the District Office, without making a final determination.

4.4 With regard to the alleged violation of article 14, paragraph 5, it transpires from the text of the judgement of the Supreme Court that the Court did deal extensively with the assessment of the evidence by the Court of First Instance.

The Committee notes that it has indeed fully taken account of the Supreme Court's decision and is mindful of the analysis contained therein.

Altogether, there was a delay of six and a half years between the author's arrest and the judgement of the Supreme Court.

The Supreme Special Court is also the Supreme Electoral Court, judging pleas against the legality of the legislative elections.

Lesotho stated that the office of the Attorney General would be the designated central authority with responsibility and power to receive requests for mutual legal assistance. Lithuania stated that the Ministry of Justice and the Prosecutor General's Office under the Supreme Court would be designated the central authorities to receive requests for mutual legal assistance.

4.1 The State party indicates that the author submitted his communication more than two and a half years after the Supreme Court judgement.
