The application of a reliability test to electronic signatures would entail major problems where, for instance, other creditors of the parties to a transaction sought access to the assets involved, alleging that the signature requirement had not been met.

It was further suggested that the Working Group should give further consideration to the list of non derogable provisions enumerated in draft article 88a (5), with a view to including in this list other obligations, such as the draft article 35 signature requirement.

It is proposed that article 35(2) be amended to omit the requirement to supply the arbitration agreement.
