4.3 On the merits, the State party contends that article 14, paragraph 5, of the Covenant does not apply when an individual is tried at first instance by the court of highest jurisdiction, for example, the Supreme Court, because of his personal situation.

4.3 In the State party's view, the Court, in dismissing the complaint as manifestly unsubstantiated on procedural grounds , did not decide on the merits, as a result of the petitioners' procedural mistake.
