The Court first recalled that Article 35 of the Statute of the Court concerns access to the present Court and not to its predecessor, the Permanent Court of International Justice (PCIJ).

At present all levels of the judiciary, except the Supreme Court, women judges.

In the present case the same judgement by the Norwegian Supreme Court is being challenged before both bodies.

The Court allegedly refused the author's request to testify and to present documentary evidence.

The Court then afforded the parties the opportunity to present new evidence, which they declined.

In counsel's view, the Mamatkulov Court was unable to find a violation of article 3 of the European Convention as, in contrast to the present case, there was insufficient evidence before the Court.

She claims that no translator was present during the District Court hearing of 22 July 1999 and that the contradictions the court found in her story are attributable to problems of interpretation.

Accordingly, on the date of this memorandum, 96 votes constitutes an absolute majority in the Assembly for the purpose of the present Court election.

4.4 The State party argues that in the present case the author was summoned to appear before the Appeals Court to present his views on the admissibility and merits of the appeal, but did not do so.

In September 2004, the Court urged the Government to present its programme of action and a timeframe for the implementation of the above mentioned decision.

The present case involved an authoritative decision by the highest Norwegian court to acquit a person accused of racist statements.

In accordance with the Statute of the Court, the Secretary General requested States parties to the Statute to provide nominations to the Court from national groups by 30 June 2005. The present document could therefore not be prepared earlier.

2. A State intervening to present a claim in a proceeding before a court of another State cannot invoke immunity from the jurisdiction of the court in respect of any counterclaim arising out of the same legal relationship or facts as the claim presented by the State.

The author adds that he was not, as the State party contended, released from the Courtroom, as he was not present in Court, but was released the following day.

In the present case it was open to the author to lodge an application for amparo proceedings before the Constitutional Court, claiming that his fundamental right had been violated in that the rules governing criminal procedures did not envisage the possibility of appealing against a sentence that was passed by the appeal court when that court was the first to convict the accused.

In the present case the Court declared admissible, but unfounded on the merits, a setting aside proceedings initiated against an award with which the arbitral tribunal had denied its jurisdiction.

In the present case, the Court noted that a full examination was not possible due to the late delivery and to the fact that the non conformity could be detected only in part.
