H. Status of justice reform

The observer for the International Centre for Criminal Law Reform and Criminal Justice Policy made a presentation on the Workshop on Enhancing Criminal Justice Reform, including Restorative Justice.

The Government has gradually shifted responsibility for reform from the Justice Reform Commission to the justice sector's three permanent national institutions, the Ministry of Justice, the Attorney General's Office and the Supreme Court.

Progress was made in juvenile justice reform in Eastern Europe.

Three new projects in justice and the rule of law support the master plan of the Afghan Judicial Reform Commission in the reform of the criminal justice system, the penitentiary system and the juvenile justice system.

Current projects cover a variety of areas, including juvenile justice reform, penal reform and victim support, as described below.

Effective criminal justice reform and practices should, where possible, be evidence based.

Reform in the justice sector has progressed more slowly than hoped for, impacting on the fair and effective administration of justice.

Minister of Justice In September, 2005, Santokhi was sworn in as Minister of Justice and Police on behalf of the Progressive Reform Party.

Institutions, including those in the private sector, that are outside of traditional criminal justice may nevertheless serve as important models for institution building and reform within the criminal justice system. Criminal justice reform cannot proceed without the active support or at least acquiescence of the community.

Some promising practices in various areas of criminal justice reform and some action oriented strategies to facilitate effective criminal justice enhancements have been identified.

(a) To expedite its work on reform of the system of juvenile justice in order for children to be tried under a specific juvenile justice system and not the ordinary justice system

The demand for technical assistance projects for the reconstruction of criminal justice systems, criminal justice reform and crime prevention has increased steadily over the past years.

The goal of the group is to bring about political reform based on democracy and social justice.

Members of the mission also met with civil society organizations working on transitional justice and judicial reform.

Criminal justice institutions and processes continue to require reform and strengthening in eastern and south eastern Europe.

This thematic sector comprises activities related to fighting corruption and money laundering and to criminal justice reform.

(a) Increase in the number of technical assistance projects initiated in the area of criminal justice reform

In the period 1996 1997, a juvenile justice reform programme was put in place that included the establishment of a department for minors within the Ministry of Justice.

Workshop 2, on Enhancing Criminal Justice Reform, including Restorative Justice , will help identify some of the many challenges facing the administration of criminal justice and encourage a discussion of recent experience worldwide in improving such administration.

Penal Reform International provides region wide technical assistance on juvenile justice in the Middle East and North Africa.

A focus on victim needs and input would also serve as a valuable guide in addressing priorities in criminal justice reform and evaluating the effectiveness of criminal justice reforms.

The justice system still requires structural reform, more qualified and committed officials, adequate legal education, and the necessary administrative tools and physical infrastructure to administer justice fairly and effectively.

Justice sector reform has been delayed by a lack of funds, qualified personnel and infrastructure, which further exacerbates the problems of access to and the timely delivery of justice.

The Government should improve women's access to justice, including reform of legislation to comply with international human rights standards.

The framework for justice reform, as defined by the Constitution, the Berlin Declaration and the national development budget, provides guidance for strengthening Afghanistan's very weak justice system and calls for investment in the rehabilitation of permanent institutions of justice.

Leadership of the reform process has shifted away from the Bonn mandated Judicial Reform Commission to the Supreme Court, the Office of the Attorney General and the Ministry of Justice (MoJ).

17. Encourages the Government of Afghanistan to finalize the national justice sector strategy and the national justice programme, and calls upon the international community to ensure the requisite support for justice sector reform, including honouring commitments made at the Rome Conference

The Ministry of Justice, the Attorney General's Office and the Supreme Court, with the technical advice and support of UNDP and UNAMA, are in the process of finalizing a strategic reform framework for the justice sector entitled Justice for all .

Speakers emphasized challenges and issues that criminal justice systems faced with an emphasis on new reform initiatives in their States.

(c) Increase in the number of expert group and consultative meetings and training sessions conducted on criminal justice reform issues.

The Office is committed to the provision of technical assistance to Member States in the area of criminal justice reform.

A number of practical considerations suggested below should be taken into account in planning, implementing and evaluating criminal justice reform initiatives.
