In line with the Committee's general recommendations, Paraguay had amended its Civil Code, Labour Code, Electoral Code and Penal Code, which now defined sexual harassment and domestic violence as serious offences.

The Labour Code protects the right of pregnant women to work and to receive maternity benefits.

This concern is enshrined in articles 59, 160, 162, 164, 165 and 169 of the Labour Code, and in articles 99 (4) and 105 of the Social Security Code.

For example, temporary disability benefits are 60 100 of the average monthly wage (article 217 of the Labour Code).

The revised Labour Code provided that no form of discrimination was permissible in the relationship between employer and employee.

The Committee hoped that the Government would take the opportunity to insert such provisions in the draft Labour Code.

Until the recent amendment of the Labour Code, all types of informal employment, including part time work and fixed time work, had been excluded from the scope of the Code.

The new Labour Code would protect women against all physical and moral abuse, and the Penal Code would criminalize domestic violence, sexual harassment and any other kind of violence against women.

The decree regulating the implementation of the Labour Code has determined women's working hours and the shifts they may work.

Section 24 of the Act respecting income security provided that programs such as STM would not be subject to the requirements of the Act respecting labour standards, the Labour Code and collective agreements.

Thus, the Labour Code provides that the rest period for women and children must last at least eleven (11) consecutive hours.

Breaks for feeding a child are regarded as work time and are paid in the wages (article 167 of the Labour Code).

The Labour Code prohibited night work for women, and women did receive technical and vocational training in the public and private sectors.

Under the Labour Code, enterprises with 150 female workers or more had to open childcare facilities for the children of such workers.

A labour contract cannot be cancelled by an employer while a worker is on leave, except when the business is being liquidated or the businessman is terminating his activities (article 46 of the Labour Code).

Bearing in mind also the International Labour Organization Code of Practice on HIV AIDS and the World of Work, adopted by the Governing Body of the International Labour Organization in June 2001,ILO AIDS 2001 2.

Changing the terms of payment for work so that they are worse for the worker is prohibited (article 102 of the Labour Code).

Thus, the enactments of the Niger, in particular the Labour Code and the General Civil Service Regulations, guarantee everyone the right to employment.

Article 144 of the Labour Code forbids employers to dismiss women who are pregnant or on pre or post natal maternity leave, except on legitimate grounds which have previously been found acceptable by the Ministry of Labour.

Child care leave may also be used, all at once or in installments, by the father of the child (article 165 of the Labour Code).

Prohibition of discrimination in employment and occupation. The Committee noted that section 3 of the draft Labour Code prohibits all discrimination in employment and occupation.

Order No. 96 039 of 29 June 1996 concerning the Labour Code of the Niger provides that a woman's pregnancy shall not justify her dismissal.

Operating in the country is a system of insurance that takes two forms State social insurance and voluntary social insurance (article 215 of the Labour Code).

Lastly, female apprentices who are minors may not lodge with their master unless his wife or another adult woman is on the premises (Labour Code regulations).

Overall, legal provisions do not discriminate against women as regards choice of profession or employment (cf. Article 25 of the Constitution, Article 5 of the Labour Code).

Benefits for pregnancy and childbirth amount to the full monthly wage for the entire period of maternity leave given to the woman (article 218 of the Labour Code).

Japan was the first country to begin modernising its legal system along western lines, by importing bits of the French, but mostly the German Civil Code.

It hoped that the Government would use the ongoing revision of the Labour Code as an opportunity to bring its legislation into full conformity with the requirements of the Convention.

Important books such as The Bible and Code of Laws were only available in Latin, Swedish or a few other European languages such as French or German.

The conditions of detention in the women's correctional labour colony are more privileged, and pregnant women and mothers are guaranteed care and medical services (article 101 of the Penal Enforcement Code).

The Labour Code contains a number of provisions to protect maternity, so that women workers can fulfil their dual roles as mothers and professionals without thereby impairing the principle of equality.

It has adopted the Labour Code and the laws on pension support for citizens, on income indexing, on State social insurance, on labour protection, on employment and on State guarantees of equal rights for men and women and equal opportunities in the exercise of such rights, and many others.

In its direct request of 2003 the Committee recalled that the unqualified prohibition of forced or compulsory labour in section L6 of the Labour Code which does not include all work required in the public interest by legislative provisions on participation in development was inconsistent with the Convention.

The development of the ILO IMO Code of Practice on Security in Ports, which is a joint work with the International Labour Organization (ILO) has been completed and the code has been approved by the ILO Governing Body in March 2004 and by the MSC in May 2004.

Other reforms had also been undertaken to bring legislation into line with international commitments, including the reform of the Labour Code, to include equality in employment and wages and protection of women against harassment, and of the Criminal Code, to protect women against discrimination, domestic violence and sexual harassment.

In 1889, on the centennial of the French Revolution of 1789, the Second International was founded, with 384 delegates from 20 countries representing about 300 labour and socialist organisations.
