61 177. International Convention for the Protection of All Persons from Enforced Disappearance

(a) To promote and give full effect to the Declaration on the Protection of All Persons against Enforced Disappearance

1. Acknowledges the adoption by the Human Rights Council of the International Convention for the Protection of All Persons from Enforced Disappearance

In 1998, these other acts were clarified to mean false imprisonment, torture, rape, persecution of a group, enforced disappearance of persons, and apartheid.

At the same time, an independent investigation should be launched to clarify the circumstances of the forced disappearance of military and civilian persons.

The Disappearance of Europe

The General Assembly of the United Nations adopted a Declaration on the Protection of all Persons from Enforced Disappearance as resolution 47 133 on December 18, 1992.

(a) That, as proclaimed in article 2 of the Declaration on the Protection of All Persons from Enforced Disappearance, no State shall practise, permit or tolerate enforced disappearances

(b) Without prejudice to other criminal procedures, aggravating circumstances, in particular in the event of the death of the disappeared person or the commission of an enforced disappearance in respect of pregnant women, minors, persons with disabilities or other particularly vulnerable persons.

(f) To pay particular attention to cases of disappearance of persons working for the promotion and protection of human rights and fundamental freedoms, wherever they occur, and to make appropriate recommendations for preventing such disappearances and improving the protection of such persons

Taking note with appreciation of the attention paid to children in the Convention on the Rights of Persons with DisabilitiesResolution 61 106, annex I. and in the International Convention for the Protection of All Persons from Enforced Disappearance,Resolution 61 177, annex.

Also recalling the Declaration on the Protection of All Persons from Enforced Disappearance adopted by the General Assembly of the United Nations in its resolution 47 133 of 18 December 1992,

These include the most reprehensible attacks against civilians, such as murder, torture, forced displacement of persons, various forms of sexual violence, enforced disappearance, detention, looting and destruction of villages and property.

(b) Aggravating circumstances, inter alia in the event of the death of the victim or the commission of an enforced disappearance in respect of pregnant women, minors or other particularly vulnerable persons.

2. Adopts and opens for signature, ratification and accession the International Convention for the Protection of All Persons from Enforced Disappearance, the text of which is annexed to the present resolution

Others called for references to conspiracy to commit enforced disappearance, and to those responsible for instigating or concealing an enforced disappearance.

Determined to combat impunity for the crime of enforced disappearance,

(b) To take all appropriate measures to clarify the fate of all cases of persons allegedly victims of enforced disappearance, including, where appropriate, taking into account the work of the national committee and international expert bodies in this field
