The compensation did not take into account the broad impairments of reduced quality of life or the increased risks that Iraq imposed on the entire populations of the Claimants.

Parallel or concurrent causes of damage Iraq contends that some of the damage for which the Claimants seek compensation cannot be attributed solely to Iraq's invasion and occupation of Kuwait.

For example, in UNCC claim Nos. 3013925, 3012838 and 3012847 the claimants seek compensation of USD 3,360,294, USD 3,891,003 and USD 6,221,107, respectively, for losses relating to three separate businesses.

The amount claimed column shows the compensation sought by the Claimants (with amendments, where applicable) expressed in United States dollars (USD) and corrected, where necessary, for computational errors.

The Claimants further argue that, under general international law, it would be an absurd and unreasonable result to deny compensation for temporary loss of resources resulting from a deliberate internationally wrongful act of aggression.

In those cases, the E4 Panel recommended no compensation for the claims when they were reviewed, as the E4 claimants had not submitted sufficient information or documents to support their asserted losses.

With respect to the claims for which the Panel recommends no award of compensation, the Panel notes that most of these claimants did not submit the requisite medical reports or death certificates to prove the fact of injury or death.

As a consequence of the consolidation of the new losses claimed by the individual claimants and the provision of evidence, the Panel recommends adjustments to the original awards resulting in a net increase in the amount of recommended compensation for the E4 claims.

The Claimants point out that none of the individual claims that have been processed by the Commission to date has included compensation for damage from loss of life or reduced quality of life that is now sought in the fifth F4 instalment.

This is relevant to the issue of streaming of claimants.

In this regard, the Panel notes that Iraq does not deny that claimants are entitled to claim compensation for the temporary loss of resources which have an economic value ( which are traded in the market ), such as fisheries and crops.

Others stated that claimants contacted them through word of mouth.

Priority of the security right over the rights of competing claimants

With respect to D1 forced hiding, illegal detention and hostage taking claims, the Panel also noted that the incidence of loss was higher among the claimants in this instalment, although they claimed compensation for fewer days in instances of forced hiding and illegal detention.

None of the claimants in this instalment fall into Stream 3.

Debt restructurings often entail conflicts among different claimants.

Both claimants claimed for their respective share of the joint venture's losses only.

The Claimants maintain that the methodologies adopted by them in estimating damage suffered by them or the compensation claimed for such damage are fully in accordance with Security Council resolution 687 (1991) and Governing Council decision 7 and are not inconsistent with any rules or principles of international law.

At the direction of the Panel, interviews were scheduled with the majority of these claimants.

The Panel finds that such sharing of evidence seriously undermines the credibility of these claimants.

In relation to the claims reviewed in the fifth F4 instalment, the evidence presented to the Panel does not indicate that any profit or other benefit accrued to any of the Claimants in connection with the events or damage in respect of which the claims for compensation have been submitted.

Having reviewed the claimants' responses to the notifications, the Panel noted that the claimants failed to provide the requested original copies of certain documents and did not provide a satisfactory explanation for this failure.

The Panel reviewed the statistical data indicating that these claimants claimed more frequently for business losses and for substantially higher amounts than claimants in the regular category D claims programme.

The Panel recalls that in its Sixth Instalment Report it identified three streams of claimants in order to address the varying circumstances of claimants, in particular the quality and quantity of business records available to support individual claims.

All of the competing claimants were interviewed during the technical missions to Kuwait and Jordan.

Claim preparers often attended interviews with claimants and frequently acted as interpreters.

The Panel notes that a number of these claimants did not appear for interview, while those who did appear were unable to explain why the remaining evidence on their claim files was virtually identical to that of other claimants.

Regarding compensation of victims, Lithuania signed the 1983 European Convention on the Compensation of Victims of Violent Crimes on 14 January 2004.

Four individual claimants that were identified as overlapping with four E4 claimants assert new or greater losses in respect of E4 claims and have provided evidence that reduced the risk of overstatement arising from evidentiary shortcomings in the E4 claims.
