States should not establish any preconditions for filing a restitution claim.

13.12 States should ensure that no one is persecuted or punished for making a restitution claim.

13.11 States should ensure that adequate legal aid is provided, if possible free of charge, to those seeking to make a restitution claim.

In the first case (the Letkov property), the Plzen mesto District Court refused the restitution claim on 13 November 1995, because the author did not fulfil the citizenship requirement during the initial period open for restitution claims, i.e. 1 October 1991 at the latest.

The State party argues that in this case, the author would not have been successful in his restitution claim even if the citizenship condition had not existed.

13.1 Everyone who has been arbitrarily or unlawfully deprived of housing, land and or property should be able to submit a claim for restitution and or compensation to an independent and impartial body, to have a determination made on their claim and to receive notice of such determination.
