The Administrative Law Unit, while functionally assigned the execution of responsibilities related to appeal matters, is an integral part of the Office of Human Resources Management (OHRM) and, within that Office, of the Division for Organizational Development.

An appeal in respect of such a decision may not be submitted to the Joint Appeals Board.

The increase in the amount of 154,800 under posts relates to (a) the delayed impact of a Local level post approved in the biennium 2004 2005 and (b) provision for one new P 4 post in the Office of the Director for an Administrative Officer in place of the post at the same level currently funded on a reimbursable basis from the extrabudgetary resources of UNEP and UN Habitat.

In the course of the year 2003, FRB SC again issued an identical order to the Government.

A management review of the appeals process at Headquarters, Geneva, Vienna and Nairobi (A 59 408) determined that the timeliness of appeals could be improved by streamlining the process at most duty stations.

This role is made clear to all parties from the initiation of the appeals process.

Several felt that such a requirement should apply only to available and effective remedies.

It has various divisions which hear challenges to judgements handed down by the Court of Appeal.

Specific detailed regulations on appeals in the context of ERA exist in Austria.

Second, the Working Group suggested means for accelerating appeals other than appeals from Judgements.

Appeals procedures are functioning well over 90 per cent of appeals (74 of 81) against decisions related to the register and cadastre were resolved within obligatory time frames.

As for the Working Group on Speeding up Appeals, chaired by Judge Mumba, I am pleased to report that it has completed its work.

Canada funded court challenges programmes to test cases on equality, including those involving persons with disabilities.

The increase of 106,900 under general temporary assistance, which is equivalent to 12 work months of a P 2 1 post, is intended to strengthen the capacity of the secretariat of the Board and the Committee in managing the appeal process.

a One of these appeals comprises 232 cases contesting the same administrative decision (of these 232 cases, 149 were filed with the JAB on 26 December 2003 but were assigned 2004 case numbers by the JAB secretariat).

Furthermore, proposals are made under this section for strengthening the capacity for servicing the Joint Appeals Board and the Joint Disciplinary Committee at the United Nations Office at Vienna, including establishment of a new P 3 post for the Secretary of the Board and the Committee and additional non post resources.

Appeals from the Court lie to the High Court on the civil side and the Court of Criminal Appeal on the criminal side.

Under staff rule 111.2 (a), this review constitutes the first step of the appeals process.

Hitherto the secretariat of the Board and the Committee in Nairobi was part of the Human Resources Management Service.

The activities will be directed towards eliminating the backlog in appeals and disciplinary cases and reducing the average case processing time.

That function is temporarily carried out by the Secretary of the Joint Appeals Board, which may potentially lead to a conflict of interest.

Most civil disputes appear before a State Court (Pengadilan Negeri) appeals are heard before the High Court (Pengadilan Tinggi).

Experience across countries indicates that it is almost as inevitable that the agency will suffer setbacks in some of these appeals, perhaps in many of them.

The Chief of Unit supervises all of the work done in the Unit and performs other managerial functions as required, in addition to dealing with appeals and disciplinary cases.
