It also wished to know how many of the appeals disposed of by the Joint Appeals Boards had been decided in favour of the staff and what percentage of the Board's recommendations in such cases had been accepted by the Secretary General.

(d) Appeals and disciplinary matters

Establishment

Hitherto the secretariat of the Board and the Committee in Nairobi was part of the Human Resources Management Service.

That function is temporarily carried out by the Secretary of the Joint Appeals Board, which may potentially lead to a conflict of interest.

(j) Where the competence of the Joint Appeals Board is in doubt, the panel constituted for the appeal shall decide.

VIII.5 The Advisory Committee recommends the establishment of a P 5 post for a full time presiding officer of the Joint Appeals Board.

The appeals are reviewed by a classification appeals body.

If this is not possible and cases reach the appeal stage, replies on behalf of the Secretary General will be filed in a timely fashion and information requested by the Joint Appeals Board will be provided promptly in order to avoid costly procedural delays in the disposition of appeals.

(iii) Preparing written statements on behalf of the Secretary General in appeals filed with the Joint Appeals Board gathering additional information that may be requested by the Board for the consideration of particular cases and personal appearances at hearings scheduled by the Board

He also pointed out that the committee or the Appeals Panel did not respond to the Mission's written requests for clarification.

(g) The secretariat of each Joint Appeals Board shall consist of a secretary and such other staff as may be required for its proper functioning.

(ii) Representing the Secretary General before the Joint Appeals Board when it is considering requests for suspension of action on a contested decision

Rule 111.1 on establishment and rule 111.2 on appeals shall apply to staff members appointed under these rules.

The Panel of Counsel represents appellants during the process.

By letter of 25 November 2002, the Supervisory Authority replied that the complaint should be made to the Board of Appeal of Insurances ( the Board ).

The legal system comprises a Court of Appeal, a Supreme Court and a Magistrate's Court, with a final appeal procedure lying open to the Privy Council of the United Kingdom.

(f) Providing guidance and supervision to the Secretaries of the Joint Appeals Board, the Joint Disciplinary Committee, the Panel on Discrimination and Other Grievances and the Panel of Counsel regarding the operational aspects of their functioning.

In most cases, the action of the Joint Appeals Board merely delayed justice for the staff, since it only made recommendations.

The increase of 106,900 under general temporary assistance, which is equivalent to 12 work months of a P 2 1 post, is intended to strengthen the capacity of the secretariat of the Board and the Committee in managing the appeal process.

a One of these appeals comprises 232 cases contesting the same administrative decision (of these 232 cases, 149 were filed with the JAB on 26 December 2003 but were assigned 2004 case numbers by the JAB secretariat).
