Appeals

(a) Conducting administrative reviews in the Office of Human Resources Management and preparing respondent's replies to the Joint Appeals Board

Hitherto the secretariat of the Board and the Committee in Nairobi was part of the Human Resources Management Service.

That function is temporarily carried out by the Secretary of the Joint Appeals Board, which may potentially lead to a conflict of interest.

(d) Appeals and disciplinary matters

By letter of 25 November 2002, the Supervisory Authority replied that the complaint should be made to the Board of Appeal of Insurances ( the Board ).

(ii) A payment against the biennium 1998 1999 of 50,853 to a UNIDO staff member as recommended by the Joint Appeals Board

The increase of 106,900 under general temporary assistance, which is equivalent to 12 work months of a P 2 1 post, is intended to strengthen the capacity of the secretariat of the Board and the Committee in managing the appeal process.

The legal system comprises a Court of Appeal, a Supreme Court and a Magistrate's Court, with a final appeal procedure lying open to the Privy Council of the United Kingdom.

2.13 On 6 August 2002, the Aliens Appeal Board upheld the decision of the Migration Board, arguing that it is easy to obtain false documents in Bangladesh and therefore they had to be considered of low evidentiary value.

2.16 On 17 March 2004, the Board of Appeal rejected Mr. Warming's application for leave to appeal the Grindsted District Court's decision to the High Court of Western Denmark.

It was only in his first appeal to the Aliens Appeal Board on 18 June 2001 that the authorities were informed that the complainant had been tortured by police in 1995 and in 1997 or 1998.

An additional P 3 post for a Legal Officer is requested for the secretariat of the Joint Appeals Board in view of the increase in the number of cases related to peacekeeping operations and the current backlog of 46 cases (ibid., para.

A management review of the appeals process at Headquarters, Geneva, Vienna and Nairobi (A 59 408) determined that the timeliness of appeals could be improved by streamlining the process at most duty stations.

This role is made clear to all parties from the initiation of the appeals process.

Several felt that such a requirement should apply only to available and effective remedies.

It has various divisions which hear challenges to judgements handed down by the Court of Appeal.

Specific detailed regulations on appeals in the context of ERA exist in Austria.

Second, the Working Group suggested means for accelerating appeals other than appeals from Judgements.

Appeals procedures are functioning well over 90 per cent of appeals (74 of 81) against decisions related to the register and cadastre were resolved within obligatory time frames.

The author's appeal to the Danish Refugee Board and his application to the Board of Appeal for leave to appeal the High Court's decision of 1 December 2003, were still pending when the State party made its submission.

The increase in the amount of 154,800 under posts relates to (a) the delayed impact of a Local level post approved in the biennium 2004 2005 and (b) provision for one new P 4 post in the Office of the Director for an Administrative Officer in place of the post at the same level currently funded on a reimbursable basis from the extrabudgetary resources of UNEP and UN Habitat.

As for the Working Group on Speeding up Appeals, chaired by Judge Mumba, I am pleased to report that it has completed its work.

Canada funded court challenges programmes to test cases on equality, including those involving persons with disabilities.

On 17 March 2004, the State party informed the Committee that, by decision of 17 February 2004, the Board of Appeal dismissed the author's application for leave to appeal against the High Court's decision of 1 December 2003.

The Advisory Committee's examination would touch not only upon the matter of the Joint Appeals Board but would also include the relevant activities of the Office of the Ombudsman, the Office of Legal Affairs, the Office of Human Resources Management, the Office of the Under Secretary General for Management as well as the Administrative Tribunal.

On 13 April 2002, FRB SC ruled that the Government of Pakistan should register Jamal Abdul Rahim with the National Authority for the Registration of Foreigners, which is equivalent to ordering the Government to release him from detention and legalize his position as an alien in Pakistan.
