The Customs Office has been allocated powers under article 1 (b) and (c) of the Customs Code, Decree Law No. 15,691, in particular with regard to the illicit trafficking of nuclear and radioactive material.

The Customs Act applies civil and criminal penalties to breaches of export controls.

Act No. 1 of 2005 on bank reorganization, currency, and credit provides that the customs authority must perform its functions as required by article 50 of the Act, which stipulates that customs officers shall have the authority to exercise the powers conferred on them under the Customs Act.

2.8.a As for import and export control operations, Act No. 20 (1998), on Customs, empowers customs officers to inspect persons, ships and merchandise, and confers on them the status of judicial police officers with the authority to investigate offences against customs regulations and to impound merchandise. Article 3 of the Customs Act also stipulates that federal and local officials and employees shall, in their respective spheres of competence, assist the customs authorities in the performance of their duties at their request and must report any violations of the Customs Act and hand over the goods involved in such violations.

The Money Laundering Act (Decree No. 45 2002) has made it possible to set up a coordinated system for analysing and monitoring unusual financial transactions related to organized crime and for detecting operations that finance terrorist, drug trafficking and other types of organizations.

In accordance with transitional articles 3, 4 and 5 of the Federal Public Administration Organization Act, the Customs Administration is under the Ministry of Defence and the Ministry of Public Security.

Act No. 17,292 (Second Emergency Act), article 64, is an amendment to the Penal Code which deals with violation of health regulations.

This was further strengthened by the 1999 Forestry Act No. 41.

According to the Customs Law, adopted in 1971, the Customs Administration is the responsible body to monitor and control import and export of all materials, equipment and goods through borders which are subject to monitoring in accordance with existing laws, regulations and procedures

Consequently, the penal provisions on arms offences that allow a sentence of imprisonment, which are currently included in the Firearms Act (1 1998) and Public Order Act (612 2003), would be placed in the Penal Code.

According to Article 128 of the RA Customs Code, all goods and transportation means exported through the Republic of Armenia customs borders are subject to declaration.
