Replying to the representative of Finland, he said that the responsibilities of Governments with respect to the activities of non State actors were very clear when the State's involvement was obvious, but much more complex when a State could plausibly deny any involvement.

He emphasized that, basically, he limited himself to reiterating the Advisory Opinion, which the international community should abide by, as it had done in the case of South Africa, condemned in 1971 for its occupation of Namibia.

In 1997, the Parties took decision X 19, which established a structure for eliminating this exemption when alternatives to ozone depleting substances used fro these purposes had been identified.

The secretariat initiated the development of this software, as requested by decision 18 CP.8, in the second half of 2003, when supplementary funds became available.

However, the Special Rapporteur is concerned about the continued opposition of some Governments to the Court's effective functioning, particularly when it takes the form of bilateral immunity agreements with States parties.

It took note of the Special Rapporteur's recommendation on the need to exercise greater control over racist and xenophobic statements, especially when they were expressed by representatives of political parties or other ideological movements.
