(30) The law applicable to the validity and effectiveness of rights and claims existing at the time of the commencement of insolvency proceedings should be determined by the private international law rules of the State in which insolvency proceedings are commenced.

The law regulates the procedure for pronouncing temporary measures for protection from domestic violence, the composition of the court, the course of the proceedings and legal remedies against the decision of the court.

Republic of Tajikistan law specifies measures targeting violations of human rights, cruel physical or mental treatment, etc.

The Law on Family regulates the institution and the course of the court procedure for ensuring court protection in a regular civil law procedure, regardless of the fact whether a criminal procedure has been instituted against the perpetrator of the domestic violence.

Specific measures are provided by the Act with regard to the control of explosives, transport of explosives, storage of explosives and purchase of explosives.

Decisive action in that regard should help to restore law and order.

Any deprivation or limitation of liberty may be imposed only in accordance with principles and under procedures specified by statute.

Improving the rule of law and instituting the fair and impartial administration of justice in Afghanistan require significant and coordinated action and investment.

These acts were condoned by the United Nations Security Council which took no remedial action to ensure the rule of law and the maintenance of regional peace and security.

As the implementation mechanisms of that law are insufficient and the elaboration of State reports and individual complaints procedures is not to be expected for it (sic) in the very near future, the existing human rights procedures gain in practical importance.

Obligations arising under international law to secure the right to access justice and fair and impartial proceedings shall be reflected in domestic laws.

Thirdly, the State party argues that even where a prosecution under section 266 (b) (1) of the Criminal Code has not been pursued, a private prosecution under section 267 of the Criminal Codeg protecting personal honour is available.

The law should provide that, notwithstanding the commencement of an insolvency proceeding, the creation, effectiveness against third parties, priority and enforcement of a security right are governed by the law that would be applicable in the absence of the insolvency proceeding.

This principle is enunciated in article 130 of the Constitution, which states The right to seek legal redress is safeguarded and is guaranteed to all. The law shall specify the procedures and circumstances under which this right shall be exercised.

The Hague Conference collaborated closely with UNCITRAL in developing the chapter of the UNCITRAL Legislative Guide on Insolvency Law dealing with law applicable in insolvency proceedings.

Article 10 of the law on State service of 1998 provides for equal access to State jobs. The law does not include any special measures like quotas for enhancing the status of women in State structures.

3. Recommends that all States give due consideration to the enactment of the Model Law, in view of the desirability of uniformity of the law of dispute settlement procedures and the specific needs of international commercial conciliation practice.

There was general agreement at all four seminars that the Convention against Corruption represented a major step forward in action against corruption and the development of international law.
